Ordered food from Zomato (restaurant name - "Tasty Treats") but the food received is stale/spoiled. Still Zomato customer care is not bothered about the customer satisfaction nor ready take the compliant. Just says apology/regret for the inconvenience and gives approval to the restaurants to cheat the customers.

If we buy food directly from restaurants the we will provide feedback to them directly and return the stale food but as the order is online thru Zomato we have to contact Zonato customer service where they are not listening to customer feedbacks.

As the Zomato customer service was not ready to take back the food and deliver the fresh food we had to wait and again spend money to buy food directly from nearby restaurant. Double the expenditure (₹652.20 paid to Zomato and ₹600.00 spent for directly purchase after getting cheated by Zomato plus the time my kids waited with empty stomach for food).

Zomato is responsible for this kind of bad experience that my family went through.

Zomato has to be punished and need help to claim my refund along with penalty charges for making my kids starve for couple of hours more at their dinner time.

You have strong case against both the Opposite parties, Zomato and the Restaurant that deliver that food.

View the similar judgment and read it carefully.

In the case of Varun Kaushik vs. Zomato Head Office, decided by the District Consumer Disputes Redressal Commission, Rohtak on September 2, 2024, the complainant Varun Kaushik, a resident of Rohtak, ordered vegetarian food through the Zomato app from a local restaurant named Do Bhai Bhojanalya. When he received the order, he found that the food was spilled and the rotis contained insects. Despite raising a complaint through the Zomato app, he did not receive any satisfactory response or resolution. After consuming the contaminated food, Varun and his family members fell ill and had to seek emergency treatment at Civil Hospital, Rohtak. He then approached the consumer forum alleging negligence and deficiency in service by Zomato and the associated restaurant, seeking compensation for the mental agony, harassment, medical expenses, and financial loss he suffered due to the unhygienic food and poor customer support. The Commission, after hearing both sides, concluded that the service provided was indeed deficient and caused genuine harm to the complainant. As a result, the court partly allowed his complaint, holding Zomato and its food partner accountable for failing to deliver safe and hygienic food, and awarded him partial compensation along with litigation costs.
