Respected Sir/Madam,
I am constrained to approach this Hon’ble Forum to file a formal complaint against Zoom Car India Pvt. Ltd. for gross deficiency in service, negligence, and unfair trade practice, arising out of their continued and unjustified failure to settle my insurance claim for over one year, despite repeated follow-ups and full compliance from my end.
The facts of the case are as follows:
1. My vehicle was listed with Zoom Car and was involved in an incident during an authorized booking period. The incident was immediately reported to Zoom Car, and all required documents and formalities were duly completed as per their procedures.
2. Despite the lapse of more than 12 months, Zoom Car has failed to disburse the insurance claim amount, without providing any valid explanation, resolution timeline, or written justification.
3. As a direct consequence of Zoom Car’s negligence and inaction:
i. My vehicle loan EMIs could not be serviced, resulting in multiple EMI cheque bounces
ii. I have incurred bank penalties, late fees, and damage to my creditworthiness
iii. I have suffered continuous mental agony, stress, and financial instability
iv. Zoom car has remained largely unresponsive and evasive, despite repeated written follow-ups
4. The conduct of Zoom car clearly amounts to:
i. Deficiency in service under Section 2(11) of the Consumer Protection Act, 2019
ii. Unfair trade practice under Section 2(47) of the Act
iii. Negligence and breach of duty of care owed to a consumer
The prolonged delay, lack of transparency, and complete disregard for my financial and mental well-being demonstrate wilful negligence on the part of Zoom car. Such conduct has left me with no alternative remedy other than seeking intervention from this Hon’ble Commission.
Reliefs Sought
In light of the above, I respectfully pray that this Hon’ble Forum may be pleased to:
1. Direct Zoom car India Pvt. Ltd. to immediately release the pending insurance claim amount
2. Award compensation for financial losses, including EMI bounce charges, penalties, and related costs
3. Award adequate compensation for mental harassment and emotional distress caused over the past year
4. Impose punitive damages to deter such negligent conduct toward consumers
5. Pass any other order(s) deemed fit in the interest of justice
I am ready and willing to submit all supporting documents, including claim records, correspondence, bank statements, EMI details, and proof of repeated follow-ups.
I request this Hon’ble Forum to take cognizance of the matter and grant relief at the earliest.
