I am fed up with having repaired my Voltas 1.5 Ton Inverter AC twice and today is the third visit regarding the gas issue again as the product is not cooling at all. I have requested earlier also to replace the product but no one has done the resolution.

Please check the gas leakage issue with the attached video recording proof of the product being defective. It's a new product which is not up to the mark. Kindly replace it as I don't want to repair it now. I have shared this email to the on Vcare@voltas.com and the managers of the area.

Hello @Anas

I'm sorry to hear about the issues you've encountered with your air conditioner's outdoor unit experiencing gas leakage. Such problems can be frustrating, especially when they persist despite multiple repair attempts. Let's explore the steps you can take to address this matter effectively.

🧾 Summary of Your Complaint

  • Product: Air Conditioner with a defective outdoor unit due to gas leakage
  • Issue: Persistent gas leakage in the outdoor unit, leading to inadequate cooling and repeated service calls
  • Attempts at Resolution: Multiple repair attempts by the service center, including gas refilling and component replacements, without a lasting solution
  • Current Status: The issue remains unresolved, and the service center is now denying further assistance or replacement.

⚖️ Legal Position

Under the Consumer Protection Act, 2019, consumers are entitled to receive goods that are free from defects and services that are rendered with due diligence. Persistent issues like gas leakage, especially when unresolvable after multiple repair attempts, can be considered a deficiency in service and a manufacturing defect.

In a similar case, M/S Daikin Airconditioning India Pvt. Ltd. vs. Mandeep Kaur, the consumer forum held the manufacturer liable for a defective air conditioner that failed to provide adequate cooling due to a faulty outdoor unit. The forum directed the company to replace the defective unit and compensate the consumer for the inconvenience caused.

✅ Steps to Take

  1. Document All Communications: Gather all records of your interactions with the service center and manufacturer, including service reports, emails, and call logs.
  2. Send a Legal Notice: Send a Legal Notice to the manufacturer and the service center, detailing the issue, previous repair attempts, and your demand for a replacement or refund. Send this letter via registered post, ensuring you have proof of delivery.
  3. Approach the Consumer Disputes Redressal Commission:

📝 Drafting a Legal Notice

Before approaching the consumer forum, it's advisable to send a legal notice to the manufacturer and service center. This notice should outline the issue, previous attempts at resolution, and your demand for a replacement or refund within a specified timeframe (usually 15 days). If you need assistance drafting this notice, feel free to ask.
