Dear Sir,

I'm writing to bring to your attention a concerning issue with ESaf Finance. I took a personal loan (Loan Number: 202010000030593) of ₹150,000 due to my husband's pressure. He was the nominee and provided signed ID proofs. I handed over the entire amount to him, and he made payments directly to Esaf's collection executive.

After several months, my husband and I separated, and I filed for divorce case against him at Aluva Family Court. I had already taken a vehicle loan (Loan Account: 72220000005708) from Esaf, which I've been paying timely.

However, five months ago, Esaf informed me that my husband hadn't paid the personal loan for 21 weeks. Despite my timely payments for the vehicle loan, my CIBIL report shows pending payments for three months.

I received a call from an Esaf Collection staff, who spoke to me in a rude manner. He demanded a ₹300 bouncing charge and threatened to seize my vehicle. They stated that this charge was due to an October EMI bounce. I cross checked my bank account statement again and again. I didnt get any bouncing details from that paticular month. I dont know why the finance people arguing with this wrong matter. Esaf staff saying only 300 Rs bouncing charge pending and I'm surprised that ESaf is involving a third-party agency for collecting this amount. However, my vehicle EMI is debited monthly from my account without any issues, and my SB account doesn't show any bouncing. The ESaf collection staff claimed to have recorded the call but later denied it when questioned by the police(5th December 2024,Time 2:30PM). When the police asked about the manager, he claimed to be the manager of the collection branch. After filing complaints with the Aluva East Police Station and Vanitha Commission regarding this issue, I received an apology from ESaf's head office through phone. However, they have now shifted their stance and are blaming me for the problem.

Recently, I filed a complaint against my husband with in Aluva East Police Station and Vanitha Station for the payment of Personal Loan (Discussion Date – 22nd December 2024). He stated that he had visited the ESaf office in Angamaly and agreed to repay the loan. The staff at Vanitha Police Station communicated with ESaf's Assistant Manager, Nisha, who verified that my husband had made a similar statement and committed to making monthly payments.

As a data entry staff member at a hospital, my monthly salary is ₹13,000. I am exploring options to refinance my loan with another institution to take advantage of better terms.

Interestingly, the Kottayam Consumer Court recently announced a decision on a similar case, which gives me hope that my request will be considered.

I would like to bring to your attention that I am a single parent living with my child, who is a scoliosis patient. I kindly request your understanding and support in this matter.

Thank you for considering my request. I look forward to your prompt response.

Sincerely,
Veena
