Brief Statement of Complaint

I purchased a motorcycle TVS RONIN 225 Red Colour from the TVS Showroom named Sri Sakthisaradha Enterprises LLP on 26 May 2026 through CSD. Within just 2 days of delivery, the bike started emitting excessive smoke. I immediately took the vehicle back to the showroom, where it was found that engine oil was not properly available/filled initially (Job Card Copy Annexed).

The showroom GSM was informed about the issue, and I was asked to wait for 1–2 days for rectification. However, without taking my prior consent, the showroom later claimed engine warranty and stated it was a manufacturing defect. They proceeded to replace major engine parts such as the piston ring and engine head without obtaining any prior permission from me.

I had already clearly informed the showroom at the time of vehicle back that if any issue arises or if any part of the vehicle needs to be changed, they must first inform me and any such work should be carried out only after taking my consent and preferably in my presence or at a time when I am available. However, when I submitted my vehicle to the showroom after the issue had arisen, this assurance was not followed, and the showroom proceeded with major repairs without my prior approval.

Due to this major engine intervention at a very early stage of the vehicle, I lost confidence, reliability, and trust in the vehicle. I therefore submitted a written request to the GSM seeking replacement of the vehicle, which was accepted by them.

However, even as of 11 August, I have not received the replacement vehicle. The matter has been pending for a long time. I had made the payment through CSD (Canteen Service Department) on 24 January 2026 and received the supply order on 29 January 2026. When I approached the showroom, I was initially informed that the vehicle was not available in red colour across India, despite have been issued an availability certificate for the same colour (Copy annexed). After repeated follow-ups and efforts, the vehicle was finally delivered on 26 May 2026.

Even after all this, I am still waiting for a proper resolution/replacement, and no clear delivery date or confirmed timeline has been provided by the TVS Showroom. Despite repeated assurances, the Opposite Party has failed to provide a definite delivery date or a satisfactory explanation for the prolonged delay. I was initially made to wait for more than five months, followed by another two months without any proper update or confirmed delivery date.

The continued delay and deficiency in service have caused me considerable inconvenience, mental harassment, and financial loss. The most inconvenient part is daily asking my superiors to travel to coimbatore for resolution of this issue as I am serving as Defence Personnel in AF Station Sulur.

I therefore approach this Hon’ble Consumer Commission seeking appropriate relief, including delivery of a replacement vehicle within a fixed time or refund of the amount paid, along with compensation for mental agony, inconvenience, and litigation expenses.
