Subject: Legal Notice regarding deficiency in service, negligence, unauthorized acts/charges, failure to resolve grievance and consequential loss suffered by the Noticee
Sir/Madam,
I Mr./Ms. ______________________, S/o/D/o/W/o ______________________, residing at ________________________________, I hereby serve upon you the present Legal Notice as under:
- I am a customer of your services and has been using your mobile/telephone/broadband/internet/data/telecommunication services under Customer ID/Account No./Mobile No. ______________________.
- That your organisation, being a service provider, is under an obligation to provide the subscribed services in accordance with the applicable terms and conditions, representations made at the time of subscription, applicable laws, regulatory requirements and accepted standards of service.
- I am facing briefly mention the issue, e.g. frequent network failure/poor connectivity/internet disruption/wrong billing/unauthorised charges/unexplained deduction/service suspension/SIM-related issue/incorrect account details/failure to provide promised service/any other grievance since __________.
- I already contacted about the aforesaid issue to your knowledge through customer care on various occasions, including Complaint/Reference No. ____________ dated ____________, and requested you to rectify the issue and provide an appropriate resolution.
- That despite repeated requests and sufficient opportunity, you have failed and/or neglected to properly resolve the grievance. The responses provided by your representatives, if any, have been inadequate, evasive, delayed and/or contrary to the actual facts.
- That your acts and omissions have caused considerable inconvenience, harassment, loss of time, financial loss and/or other consequential loss to me. I am deprived of the benefit of the services for which consideration has been paid and/or has been subjected to charges/actions which were not justified or properly explained.
- I already made every reasonable effort to resolve the matter amicably through your internal grievance redressal mechanism. However, your failure to provide an effective and timely resolution has left with no option but to issue the present Legal Notice.
- That your conduct, depending upon the facts and circumstances of the matter, may constitute deficiency in service, unfair/restrictive trade practice, negligence and/or other violation of the rights available under applicable law, for which you may be liable for appropriate legal consequences.
Please remove the point which are not required.
Therefore, through this Legal Notice, you are hereby called upon to:
a. Immediately rectify/remedy the grievance complained of by my client;b. Restore/activate/repair/continue the subscribed service, wherever applicable;
c. Reverse/refund all unauthorised, incorrect or disputed charges, along with applicable interest, wherever legally payable;
d. Provide a complete and itemised statement of account/billing and usage details, wherever relevant;
e. Provide a written explanation for the acts/omissions and failure to resolve the grievance;
f. Pay appropriate compensation for the inconvenience, harassment, loss and consequential damages suffered by my client;
g. Reimburse the costs and expenses incurred by my client in pursuing the grievance and issuing the present notice; and
h. Take all other necessary corrective measures to ensure that the grievance does not recur.
You are hereby called upon to comply with the aforesaid demands and provide a written response within 15 days from the date of receipt of this Legal Notice.
In the event of your failure, refusal or neglect to comply with the above demands within the stipulated period, I shall be constrained to initiate appropriate legal proceedings before the competent Consumer Commission/Regulatory Authority/Court or any other appropriate forum, as may be permissible under law, without any further notice to you.
In such an event, you shall be solely responsible for all costs, expenses, compensation, interest, damages and other legal consequences arising therefrom.
This notice is issued without prejudice to all other rights, remedies, claims and contentions available under law, all of which are expressly reserved.
