Col.Suresh B Ghorpade (Retd)., resident of Kadugodi, Bangalore has filed this complaint U/s.35 of the Consumer Protection Act, 2019 against the OP Gati Movers and Packers, Represented by Mr. Naveen Kumar, Bengaluru, praying to direct the Gati Movers and Packers to pay Rs.1,50,000/- towards damage of the car and motorcycle, Rs.47,200/- paid for insurance of the car, motorcycle and household luggage and to pay total transportation charges of Rs.34,107/- due to breach of contract, gross negligence and fraud and grant such other reliefs as this Commission deems fit to grant under the facts and circumstances of this case.
The brief facts are that:-
The complainant engaged the service of Gati Movers and Packers for sending car, motorcycle and other household items to his son Lieutenant Colonel Akshay Ghorpade who is serving Indian Army Officer currently posted in Bareilly, Uttar Pradesh. One Mr.Naveen Kumar who told that he was an agent of Gati Movers and Packers has given his phone number as 9036715907 and the whatsapp number as 9121741569 along with Aadhar card number, driving license and Marketing ID. He demanded Rs.81,307/- including insurance of transportation of car, motorcycle and household items, out of which Rs.40,000/- + Rs.7,200/- as GST totally Rs.47,200/- was charged for the insurance of car, motorcycle and housel hold items, but the insurance receipt was not provided. The complainant on 15.11.2022 paid Rs.21,095/- and the son of the complainant paid in three online transactions of Rs.12,402/- Rs.7,810 and Rs.40,000/- through State Bank of India, Jui Branch Tehisil Bhiwani Haryana. Gati Movers and Packers has issued the receipt for the said amount.
Order
The Gati Movers and Packers was liable to pay Rs.15,000/- to the complainant and to refund Rs.47,200/- towards insurance for transportation of the vehicle and house hold items with interest @ 9%p.a. within two months from the date of the order. Further Gati Movers and Packers is directed to pay cost of litigation of Rs.3,000/- within two months from the date of the order, failing which the said amount carry interest at 9% p.a. till payment.
