I am filing this formal complaint against the Opposite Party, Nepenthe Coffee and Chocolates Private Limited (operating under the brand name "Ditch The Guilt"), for intentional financial fraud, deficiency of service, and unfair trade practices under the Consumer Protection Act, 2019.
FACTS OF THE CASE:
In light of the above facts, I respectfully pray before this Hon'ble Forum to direct the Opposite Party to:
I, Apeksh Naidu B G, residing at Bengaluru, do hereby verify that the contents of this complaint are true to the best of my knowledge and belief.
FACTS OF THE CASE:
- On 4th August 2026, I placed an order for food items on the Opposite Party’s official website (ditchtheguilt.fit). The order reference number is #49627
- I made a full advance payment of ₹300 via UPI. The transaction ID is T2608040046347455579993. The payment was processed through their merchant gateway (RazorPay).
- As per the terms of purchase, the items were supposed to be delivered within a reasonable time frame. However, more than 40 days have passed, and the product has not been shipped or delivered.
- Lack of Communication: I have repeatedly attempted to contact the company via their official support email Info@ditchtheguilt.com, to track my order. The Opposite Party has completely ignored all communications.
- Systemic Consumer Scam: A cursory check on public consumer forums, Google Reviews, Reddit, and social media platforms reveals that the Opposite Party is actively running highly discounted advertisements to lure consumers, pocketing prepaid amounts, and intentionally failing to deliver goods. This points toward a pre-meditated, large-scale consumer scam operated under a corporate guise.
In light of the above facts, I respectfully pray before this Hon'ble Forum to direct the Opposite Party to:
- Refund the principal amount of ₹300 immediately to my original mode of payment.
- Pay interest at the rate of 18% per annum from the date of the transaction until realization.
- Pay reasonable compensation for the mental agony, harassment, and litigation expenses caused by their deceptive practices.
