Complaint under Consumer Protection Act, 2019
I, Prabhpreet Singh S/o Jatender Singh, R/o 1B/67, Ramesh Nagar, New Delhi-110015, am a Prime Member of Amazon. I am filing this complaint against Amazon Seller Services Pvt Ltd and Seller “Kay Kay Overseas Corporation Store” for deficiency in service, unfair trade practice, mental harassment and causing huge mental agony.
On 14 May 2026 at 7:19 PM, I ordered “AGARO Rejoice Foot, Calf and Leg Massager” (Grey) vide Order No. 406-0389718-6770705 for my mother who is suffering from severe foot and calf pain. I paid Rs. 8,615.89 through HDFC Credit Card. Amazon also charged extra Rs. 299 (Bank Processing Fee) + Rs. 53.82 (GST).
The promised delivery date was 21 May 2026. However, the product was never shipped. Every time I contacted customer care through live chat, the executives would join the chat, ask for details and leave within 1-2 minutes. I had to repeat my entire problem again and again. This repeated behaviour caused me extreme frustration and mental stress.
After kept asking for the Delivery, they also raised the Ticket for "Delivery in 72 hours." The Ticket has been submitted successfully. Ticket ld: ec9befb2-4b1b-496f-aa6a- 8b2a8d6677d.
Later, Amazon gave a revised delivery date of 26 May 2026. Meanwhile, the seller increased the price of the same product to Rs. 12,659. Customer care told me the seller had no stock. Despite me clearly telling multiple times that I do not want to cancel the order, Amazon unilaterally cancelled my order on 27 May 2026 without my consent. This made me feel deeply cheated and harassed.
On 29 May 2026, Amazon refunded only Rs. 8,615 but deliberately did not refund the Rs. 352.82 (Processing Fee + GST). When I spoke to executive Ayesha, she behaved rudely, refused to refund and ended the chat saying “We can’t do anything. You can file complaint anywhere.”
The entire conduct of Amazon and the seller has caused me severe mental agony, emotional distress, and wastage of my valuable time and energy. As a son who only wanted to help his mother’s pain, the false promises, delays, forced cancellation and rude behaviour of customer care has left me deeply hurt and disappointed.
Prayer / Relief Sought:
1. Refund of Rs. 352.82 along with 18% interest.
2. Compensation of Rs. 50,000 for mental harassment, agony, time and energy loss.
3. Punitive damages of Rs. 25,000.
4. Cost of litigation.
5. Any other relief as this Hon’ble Commission deems fit.
