Dear Sir/Madam,

I wish to submit a formal consumer complaint against HSBC Bank and Poonawalla Fincorp Limited regarding the continued restriction and non-availability of my ₹5,00,000 funds, despite the complete closure of my education loan.

I had taken an education loan from Poonawalla Fincorp Limited. As security against the said education loan, Poonawalla Fincorp arranged/opened a ₹5,00,000 Fixed Deposit with HSBC Bank.

The education loan has now been completely closed/foreclosed, and I have received the necessary loan closure documents/NOC from Poonawalla Fincorp.

After closure of the loan, I contacted HSBC Bank and requested that the Fixed Deposit be released/broken. HSBC informed me that Poonawalla Fincorp had to take the necessary action. When I contacted Poonawalla Fincorp, they informed me that they could not do anything and directed me back to HSBC Bank.

For approximately 2–3 months, I repeatedly contacted both HSBC Bank and Poonawalla Fincorp through telephone calls and emails, but neither party provided a proper resolution. I was continuously directed from one institution to the other.

Eventually, the Fixed Deposit was broken and the ₹5,00,000 amount was credited to my HSBC Savings Account. However, even after the amount was credited to my account, I am still unable to transfer the said amount to another bank account or freely use my own funds.

When I contacted HSBC again, HSBC told me to contact Poonawalla Fincorp. When I contacted Poonawalla Fincorp, they again told me to contact HSBC. Therefore, both parties are refusing to take responsibility and I am suffering unnecessarily.

This entire matter has caused me significant financial inconvenience, mental harassment, loss of time and hardship. I have made repeated attempts to resolve the matter directly with both institutions, but no satisfactory resolution has been provided.

RELIEF REQUESTED​

I respectfully request the Hon'ble Consumer Commission to:

  1. Direct HSBC Bank and Poonawalla Fincorp to immediately remove any remaining lien, hold, freeze or restriction on my ₹5,00,000 funds, if any.
  2. Direct HSBC Bank to allow me to freely withdraw/transfer/use my ₹5,00,000 funds.
  3. Direct both Opposite Parties to provide a written explanation regarding the reason and basis for the continued restriction/non-transferability of my funds.
  4. Award appropriate compensation for the unnecessary delay, financial inconvenience, mental harassment and hardship caused to me.
  5. Award litigation and legal expenses incurred by me.
  6. Grant any other relief that the Hon'ble Commission may deem fit and proper in the interest of justice.
I therefore request your good office to kindly register/take cognizance of my complaint and initiate appropriate proceedings against HSBC Bank and Poonawalla Fincorp Limited.

I am ready to provide all original documents and supporting evidence whenever required.

Kindly acknowledge receipt of this complaint and inform me regarding the further procedure for filing/pursuing the consumer complaint.
