Dear Sir/Madam,

I am writing to formally raise a consumer complaint against Grover Hyundai, Ludhiana, regarding the unsatisfactory handling of my vehicle's insurance claim, lack of proper disclosure regarding the approved repair/replacement, and deficiency in service provided by the dealership.

1. Background

I approached Grover Hyundai for an insurance claim primarily because of damage to the front lower bumper of my vehicle.

The purpose of initiating the claim from my side was very specific: I wanted the damaged bumper to be properly replaced/repaired through the insurance claim.

During the claim process, however, several other repair items were included in the survey/claim, including:

  1. Front bumper – New
  2. Left-side fender – Repair
  3. Rear bumper – Repair
  4. Right-side quarter panel – Repair
  5. Right-side rear door – Repair
  6. Left-side rear door – Repair
I had no particular requirement for most of these additional repairs. My primary concern was the front lower bumper.

2. Issue Regarding "Front Bumper – New"

The dealership/representative communicated to me that the front bumper was approved as "new."

As an ordinary consumer, when I was told "Front Bumper – New," my reasonable understanding was that the required/damaged front bumper would be replaced with a new bumper.

However, after the survey was completed, I was informed that only the upper portion of the front bumper had been approved as new, while the lower portion, which was the actual reason I approached the dealership for the claim, would not be replaced.

I subsequently questioned the dealership regarding this matter.

I was informed that the surveyor had approved only the upper portion and that the lower portion was not being covered under the claim.

3. Lack of Proper Disclosure Before Initiating the Claim

My major grievance is that this limitation was not clearly explained to me before the insurance claim was initiated and processed.

Had I been informed at the beginning that:

"Front Bumper – New" would mean only the upper portion of the bumper and that the lower damaged portion would not be replaced,
I would have reconsidered whether to initiate the insurance claim at all.

Instead, the claim proceeded, other repair items were added, and I am now being asked to accept an outcome where the primary purpose for which I approached the dealership remains unresolved.

4. My Communication With the Dealership

I repeatedly contacted the dealership and explained that I had approached them primarily for the bumper issue.

I was also told that the bumper had been damaged from the side and therefore the complete bumper could not be approved by the surveyor.

I understand that the insurance company/surveyor has its own assessment process. However, my grievance is against the lack of clear communication and guidance by the dealership before and during the claim process.

If the dealership knew that only a particular portion of the bumper was likely to be approved, this should have been clearly communicated to me before proceeding.

5. Unnecessary Financial Impact

I am also concerned that I may now have to bear the consequences of an insurance claim, including applicable depreciation and potential impact on the vehicle's insurance claim history, while the specific repair/replacement for which I primarily initiated the claim has not been satisfactorily resolved.

I therefore fail to understand the consumer benefit of proceeding with such a claim when the primary issue remains unresolved.

6. Deficiency in Service

I believe the above circumstances constitute a serious deficiency in the service provided to me as a consumer, particularly with respect to:

  • Lack of transparent communication regarding the exact scope of the insurance claim.
  • Failure to clearly explain what "Front Bumper – New" actually meant.
  • Failure to adequately address my primary requirement.
  • Including multiple additional repair items without resolving the principal issue raised by me.
  • Requiring repeated follow-ups through calls and WhatsApp to obtain basic information regarding my vehicle and claim.
  • Causing unnecessary inconvenience, loss of time and uncertainty.
I have retained the relevant WhatsApp conversations and other documents relating to the claim and communication with the dealership.

7. Relief Requested

I respectfully request the appropriate Consumer Authority/Consumer Commission to examine the matter and provide appropriate relief, including, as applicable:

  1. Directing the dealership/service provider to properly resolve the front lower bumper issue.
  2. Directing the concerned parties to provide complete documentation of the survey report and claim approval.
  3. Determining whether the claim and repair scope were properly disclosed to me before the claim was processed.
  4. Providing appropriate compensation for the inconvenience, harassment, loss of time and deficiency in service suffered by me.
  5. Reimbursement of any unnecessary expenditure incurred by me due to the deficiency in service, wherever applicable.
  6. Taking any other action or granting any other relief deemed appropriate under applicable consumer protection law.

I request that this complaint be considered seriously and that appropriate action be taken to protect my rights as a consumer.

I am willing to provide any additional information or documentation required in support of my complaint.

Thank you.

Yours faithfully,
Nitesh Shukla
