COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019 FOR DEFICIENCY IN SERVICE AND UNFAIR TRADE PRACTICE
MOST RESPECTFULLY SHOWETH:
1. DETAILS OF THE COMPLAINANT & JURISDICTION:
1.1 The Complainant is an individual consumer residing at the above-mentioned address. The Complainant is a registered user of the mobile application operated by Opposite Party No. 1 (hereinafter referred to as "Blinkit").
1.2 This Hon’ble Commission has the territorial jurisdiction to entertain this complaint under Section 34(2)(d) of the Consumer Protection Act, 2019, as the Complainant resides within the territorial limits of this Commission.
2. FACTS OF THE CASE:
2.1 That on 22/08/2026 at approximately 04:30 PM, an unauthorized fraudulent transaction of ₹15,043.00 was executed from the Complainant’s Blinkit account using saved credit card details (Axis Bank Credit Card ending in 3090).
2.2 That the unauthorized third party breached the account security of the Complainant, modified the delivery address to a completely different location/state, changed the associated phone number, and successfully placed high-value orders without triggering any multi-factor authentication, security alert, or suspicious-activity detection on Blinkit’s platform.
2.3 That the Complainant has continuously retained physical possession of his mobile handset and SIM card, and did not share, forward, or disclose any OTP, password, PIN, or card credentials with any third party.
2.4 That Blinkit failed to send any primary security intimation, email, or SMS notification to the Complainant regarding critical account modifications—such as logging in from a new/unrecognized device, updating the registered phone number, or modifying the default delivery address to another state—prior to order execution.
3. DEFICIENCY IN SERVICE AND NEGLIGENCE:
3.1 Severe Security Lapses: Opposite Party No. 1 failed to implement mandatory IT security protocols, device-binding checks, and suspicious transaction flags, rendering the platform vulnerable to third-party account takeover and unauthorized access.
3.2 E-Commerce Rules Non-Compliance: As per the Consumer Protection (E-Commerce) Rules, 2020, e-commerce entities are mandated to ensure robust data security and safety mechanisms to protect consumer financial credentials. Allowing saved card details to be processed automatically after a sudden, unverified address/phone change constitutes gross negligence.
3.3 Admission by Opposite Party: Opposite Party No. 1 has officially admitted via email correspondence that an unauthorized third party ("sender") accessed the Complainant’s account and executed the order. Despite acknowledging the breach, Opposite Party No. 1 failed to reverse the fraudulent transaction or compensate the Complainant.
4. TIMELY ACTION BY COMPLAINANT:
4.1 The Complainant blocked the credit card immediately upon receiving the transaction SMS from the bank.
4.2 The Complainant formally reported the cyber fraud to law enforcement and registered an official complaint on the National Cyber Crime Reporting Portal (Acknowledgement No: 21908260115724).
4.3 The Complainant raised a dispute with Axis Bank under RBI’s Zero Liability guidelines and notified Blinkit within 3 days of the incident.
5. CAUSE OF ACTION:
The cause of action arose on 22/08/2026 when the security breach occurred and an unauthorized transaction of ₹15,043.00 was processed. It further arose on subsequent dates when Opposite Party No. 1 acknowledged the breach but failed to resolve the grievance and refund the amount.
6. PRAYER / RELIEF SOUGHT:
In light of the facts and circumstances stated above, the Complainant most respectfully prays that this Hon’ble Commission may be pleased to:
a) Direct Opposite Party No. 1 (Blinkit) to refund/reimburse the complete fraudulent amount of ₹15,043.00
b) Direct Opposite Party No. 1 to Provide full technical audit logs (IP Addres, Device Identifiers, Geo-location, Recipient delivery address, Delivery persons KYC as name of the delivery boy matching with famous personality of state)
c) Direct Opposite Party No. 1 to pay towards litigation expenses incurred by the Complainant.
d) Direct Opposite Party No. 1 Disclose Complete Platform Fraud Metrics : Provide details and aggregated data of all fraudulent transactions and reported account breach incidents executed across the Blinkit platform in India, along with the resolution status and total financial loss reported by affected customers.
e) Pass any other order(s) or direction(s) as this Hon'ble Commission may deem fit in the interest of justice.
