The Hon’ble District Consumer Disputes Redressal Commission
I, the Complainant, hereby file this complaint under Section 35 of the Consumer Protection Act, 2019 against Flipkart for deficiency in service and adoption of unfair trade practices.
Facts of the Case:
That I had placed an order through the Opposite Party’s platform on a discounted offer.
That as per the tracking details, the said product has been lying at the nearest delivery hub in Mumbra since 18 April 2026, but has not been delivered till date.
That no valid reason has been provided for the delay, and false delivery attempts/updates may have been reflected.
That I purchased the product during a time-sensitive offer, due to which I deliberately skipped other available offers in reliance on the Opposite Party’s commitment.
That the product was purchased on EMI, and the installment amount is due to be charged in my upcoming billing cycle, despite non-delivery of the product.
Grounds for Complaint:
Deficiency in Service (Section 2(11)): Failure to deliver the product within a reasonable time despite its availability at the nearest hub.
Unfair Trade Practice (Section 2(47)): Misleading advertisements and offers that induce customers to make purchases, followed by failure to fulfill delivery commitments.
Mental Harassment & Financial Loss: Due to delay, false commitments, and EMI liability without receiving the product.
Relief Sought:
I respectfully pray that this Hon’ble Commission may be pleased to:
Direct the Opposite Party to immediately deliver the product without further delay, OR
In the alternative, direct the Opposite Party to refund the full amount paid as per the current price 65000, along with applicable interest
Award compensation for mental harassment and financial loss suffered
Direct the Opposite Party to bear litigation costs
Pass any other order deemed fit in the interest of justice
