Before the Hon'ble District Consumer Disputes Redressal Commission


Subject: Complaint under the Consumer Protection Act, 2019 against Reliance Digital for Mis-selling, Unfair Trade Practice, Deficiency in Service, and Consumer Fraud



Respected Sir/Madam,


I am filing this complaint against Reliance Digital for adopting unfair trade practices, providing false and misleading information, and deliberately inducing us into purchasing a product that was materially different from what we had selected.


On 20 July 2026, we visited a Reliance Digital showroom to purchase a TCL 32-inch S5K Full HD TV for delivery to our residence in Kolkata. We had already finalized the product and were ready to complete the purchase.


At this stage, a salesperson, Mr. Saleem Malik C (Mobile: 7871453634), intervened and persuaded us not to buy the TCL television. Instead, he aggressively promoted a Toshiba television by making several false and misleading representations, including:


  • That the Toshiba TV was a better product and available under a special offer.
  • That it had 26W sound output, compared to 24W on the TCL TV.
  • That both televisions were QLED models with identical specifications and display quality.
  • He demonstrated a 43-inch Toshiba 4K Ultra HD television and falsely represented that the 32-inch Toshiba model possessed the same display resolution, picture quality, and specifications.
  • He deliberately failed to disclose the actual model number of the television being sold before billing.

Believing these representations to be true, we trusted the salesperson and proceeded with the purchase.


Only after the purchase did we discover that the product supplied was the Toshiba 32-inch E36RP, which is not comparable to the TCL 32-inch S5K in terms of specifications, display technology, resolution, and overall features. The salesperson knowingly misrepresented the product and induced us to purchase a lower-specification television by showing a completely different 43-inch 4K model.


Further, the salesperson informed us that he had matched the online price available on Flipkart. However, we later discovered that he compared the price applicable to Chennai, whereas our purchase was for delivery to Kolkata. As a result, we were made to pay approximately ₹1,500 more than the applicable online price for our delivery location.


The above conduct clearly amounts to:


  • Deliberate misrepresentation of product specifications.
  • Mis-selling through false promises and misleading demonstrations.
  • Unfair trade practice under the Consumer Protection Act, 2019.
  • Deficiency in service.
  • Deceptive sales practices causing financial loss and mental harassment.

Following the incident, we approached Reliance Digital through their customer support and escalation channels seeking a fair resolution. Unfortunately, despite repeated follow-ups, the company has failed to provide any satisfactory response or meaningful resolution. Their inaction has compelled us to seek legal redress before this Hon'ble Commission.


In view of the above facts, I respectfully pray that this Hon'ble Commission may kindly direct Reliance Digital to:


  1. Replace the Toshiba 32-inch E36RP TV with the originally selected TCL 32-inch S5K Full HD TV, or alternatively provide a full refund of the purchase amount.
  2. Refund the excess amount charged due to the misleading price comparison.
  3. Award compensation for the mental agony, inconvenience, loss of time, and unfair trade practices adopted by the retailer.
  4. Direct Reliance Digital to take appropriate disciplinary action against the concerned salesperson for misleading consumers and making false representations.
  5. Grant any other relief that this Hon'ble Commission deems fit and proper in the interest of justice.

The actions of Reliance Digital and its representative demonstrate a clear disregard for consumer rights and amount to deceptive business practices. I therefore request this Hon'ble Commission to take appropriate action under the Consumer Protection Act, 2019, to ensure justice and to prevent such practices from affecting other consumers.
