Since i am abroad, my nephew Mr. Joseph D'Cruz is attending the cases and i have attended couple of times during crucial time.
The CC court has issued 3 Non-Bailable Warrant to B.K. Developers under section 27, through Police Inspector of Sangvi Police Station, during Feb 2023 to April 2024, but NO action has been taken by the Sangvi Police station and the culprit is roaming freely around the city. This shows that there is no meaning for the NON BAILABLE WARRANT (COPY ATTACHED). I had also personally informed the dates to attend the case or his lawyer, but he has failed to attend the court till date. The owner is a housewife and is always available at home, whereas the husband is running the business and enjoying government benefits under the nose of government.
I also understand that B.K. Developers has already sold the property which i had booked with them and i had clearly mentioned in my case dated 17-05-2022 that his property should be withheld to the court, but no sort or things are happening. Even i had personally requested to take action the Sangvi Police Inspector, but till date the case is running from one side.
When i visited personally on 19-Aug 2024, one judge was not available, and the date was given on 08-Oct-2024. and in August i had submitted application to send the notice to the commissioner officer to Sangvi Police Station. When my nephew visited on October, it was informed that notice will be sent, but when i checked the notice, the notice was not sent, and it was just to attend again on 23-Dec-2024.
When my nephew attended on 23-12-2024, again one of the judges was not available and after waiting for an hour they informed that they would convey online, and the next date was on March 8, 2025. The court informed that they would issue notice within 10 days' time to Commissioner of Pimpri Chinchwad, but till now no notice has been sent and when i called your office today, they mentioned that we have visit your office. This is ridiculous to learn that in spite of giving twice applications your office has failed to provide notice to CP.
This is very pathetic situation of our country and those involved in Govt duties, and no one is accountable for their services and innocent people are just neglected and harassed. I have also filed case in Chakli Police Station in May 2022 through Commissioner Office and the file is still rotten over there.
I am under the impression that CC Court are very fast, but i am struggling since Nov 2021 to receive my funds the Builder. The builder has also provided the cheque twice, but all were bounced.
If the CC Court is not able to sort the issue, please let us know so that we can approach to District and Session Court, Pune.
