I am writing to formally lodge a complaint against Eureka Forbes regarding a gross deficiency in service and unfair trade practices concerning the Annual Maintenance Contract (AMC) for my water purifier.
1. The Facts of the Case: On 08-01-2025, I purchased an AMC for my Eureka Forbes water purifier, paying a sum of Rs.4749. At the time of purchase, the machine was in working condition. On 11-01-2025, a technician from Eureka Forbes visited my premises for the mandatory verification/inspection. During the visit, the machine stopped functioning. The technician explicitly stated that because the machine was not working, I was not eligible for the AMC plan. The technician assured me at that moment that since the AMC could not be activated, the amount paid would be refunded to me. Subsequently, I contacted Eureka Forbes Support to process this refund. I was shocked to be informed that the refund is denied because "AMC is non-refundable as per norms."
2. The Grievance: This action by Eureka Forbes constitutes a "Restrictive and Unfair Trade Practice" under the Consumer Protection Act, 2019. The company has created a paradox where: They refuse to provide the service (repair/maintenance) claiming I am ineligible. They refuse to return the money paid for said service. The company cannot retain consideration (money) for a contract they have effectively declared void/invalid. By denying the validity of the AMC, the company has no legal right to hold the payment made for it. Retaining these funds without providing service amounts to unjust enrichment and misappropriation of funds.
3. Relief Sought: I demand the following immediate actions: Immediate Refund: A full refund of the AMC amount paid (Rs. 4749).
