Complaint Regarding Unfair Bounce Charges, Inflexible EMI Due Date, Mental Harassment, and Financial Discrepancies

Details of the Complaint:
• - I purchased a mobile phone under EMI from Bajaj Finance in good faith and began repayment on time.
• - I had clearly informed at the time of purchase that my salary is credited between the 4th and 6th of every month, yet the EMI due date was fixed on the 2nd, without flexibility or consent.
• - I made one EMI in advance, and continued to pay most EMIs within 2–3 days of the due date, once salary was credited.
• - Despite this, unfair bounce charges and late payment penalties were imposed on my account.
• - I raised multiple service requests (including SR145492650 and SR148093550) and submitted my bank statements proving the availability of funds after the 5th.
• - I continued to receive harassing calls and SMS, even when EMIs were paid.
• - There were inconsistencies between the Bajaj Finserv app (showing 7 EMIs paid) and the statement of account (showing only 3 EMIs).
• - Bajaj Finance also attempted to collect money through UPI IDs not authorized by me (e.g., bajajpay.6879729.06388286@indus).
• - Even after repeated written requests to adjust the EMI cycle or waive the bounce charges, Bajaj Finance refused to take corrective action.
Legal Grounds:
• - Unfair Trade Practice – Section 2(47) of Consumer Protection Act, 2019
• - Deficiency in Service – Section 2(11)
• - Harassment and Violation of Privacy – Section 2(9)
• - Mental agony and inconvenience caused by repeated fraudulent calls and misinformation
Relief Sought:
• - Refund of all bounce charges and late fees levied (with full breakdown)
• - I don’t want any kind of Compensation of for mental harassment, inconvenience, and data misuse, but need a Justice to the people who purchase the Product on EMI Basis
• - Direction to Bajaj Finance to align EMI due date with my salary cycle (after 5th)
• - Action against the use of unauthorized UPI IDs for payment collection
• - Any other relief the Hon’ble Commission deems fit in the interest of justice
