It started when I bought new car , Shortly thereafter, I began receiving repeated unsolicited phone calls from representatives of [w international holidays ]. I do not know how they obtained my personal contact number. The callers claimed that I had been selected to receive a complimentary gift for purchasing a new car and repeatedly invited me to visit their office to collect it.
Despite clearly declining their invitation on several occasions, the company continued to harass me with persistent calls. I received approximately 20 to 30 calls per day from different mobile numbers, causing significant inconvenience and mental harassment. Eventually, due to their continuous follow-up and false assurances, I agreed to visit the location specified by them.
Upon arriving at their office, instead of providing the promised gift, I found myself subjected to an aggressive sales presentation for their holiday membership package. Multiple sales representatives surrounded my family and me, creating an intimidating atmosphere and exerting undue pressure to purchase the package. We were repeatedly assured that the membership offered excellent value and that there was absolutely no risk involved.
During the sales process, the representatives made several false and misleading representations to induce us into purchasing the membership. They specifically informed us that:
- We were required to pay only 30% of the total package amount initially.
- We could use the holiday package immediately after making the initial payment.
- Once we were satisfied with their services after our first trip, we could pay the remaining amount.
- The membership would remain valid for a period of 3 to 5 years.
- We could request bookings at any time during the validity period by simply informing the company in advance, and they would arrange hotel accommodations accordingly.
However, after making the payment, the conduct of the company changed completely. Whenever I attempted to make a booking, the company would invent new conditions and excuses. Initially, I was informed that bookings required at least 15 days' prior notice, although during the sales presentation I had been assured that one week's prior intimation through email would be sufficient.
Approximately one year after purchasing the membership, I requested a booking under the package. To my surprise, the company refused to provide the promised services and demanded payment of the remaining membership amount before processing any reservation. When I reminded them of the assurances given at the time of sale, they denied making any such promises. Instead, they falsely claimed that I had waited too long to use the package and that my booking request was no longer valid, despite the membership being represented as valid for 3 to 5 years.
Furthermore, I later discovered that the advance payment of ₹30,000 was being treated as non-refundable. This crucial condition was never disclosed to me before or at the time of making the payment. Had I been informed that the amount would be non-refundable or that I would be unable to use the membership without paying the entire balance immediately, I would never have agreed to purchase the package.
Since then, I have made several attempts to contact the company for assistance and resolution. However, no responsible representative has addressed my grievance. The sales personnel who persuaded me to purchase the membership are no longer available or refuse to respond, and the company has failed to provide either the promised services or a refund of my money.
The actions of the opposite party constitute:
- Deficiency in service.
- Unfair trade practice.
- Misrepresentation and false promises to induce the purchase.
- Harassment through persistent unsolicited marketing calls.
- Failure to honour the contractual assurances made at the time of sale.
The complainant respectfully prays that this Hon'ble Commission may kindly:
- Direct the opposite party to refund the advance amount of ₹30,000 along with applicable interest from the date of payment until realization.
- Award appropriate compensation for mental agony, harassment, inconvenience, and financial loss suffered due to the unfair trade practices of the opposite party.
- Award litigation costs incurred in pursuing this complaint.
- Direct the opposite party to discontinue such misleading and deceptive sales practices against consumers.
