I have an unfurnished flat which i wanted to rent to a corporate. The corporate wanted it furnished. They had a list of furnishings , which they said would share after 8-September-2026.I had a separate tentative list of furnishings which i got from another source.
I went to Livspace company for home furnishings. Vikram Bhoopathy from Livspace, Bangalore assured me all the items in the tentative list would be met within the final cost of Rs 4.5 lakhs. This was a verbal assurance.
Vikram then asked for an advance of Rs 60,000/=. I told Vikram that i could cancel the order anytime , since the corporate had not shared the complete list of furnishings. Vikram assured me that the Rs 60,000/= was fully refundable anytime. This was a verbal assurance. Based on this assurance , i paid the amount of Rs 60,000/= by GPay. The next day they arranged for a site measurement. They asked me to pay an additional Rs 15,000/=. I paid this by GPay.
I asked vikram to send me the list of items included in the pricing of Rs 4.5 lakhs. Surprisingly, 60% of the items in the tentative list of items had not been covered. I asked for a refund of the amount i had paid, but Livspace is refusing to refund the amount. They say they have a "No Refund" policy. I told them that "No refund policies" are legally void under Section 2(47)(viii). But they refuse to listen.
Hence , i believe i have been cheated from what i had been promised. I had given Livpsace a tentative list of furnishings to be done , which they assured me was completely covered within the budget of Rs 4.5 lakhs, while the final list of furnishings that they shared with me, covers hardly 40% of the tentative list. Hence i want the refund of the advance of Rs 60,000/= ,the Rs 15,000 for the site measurement, and Rs 1,00,000/= as compensation for mental harassment.
