BEFORE THE HON’BLE DISTRICT CONSUMER DISPUTES REDRESSAL COMMISSION, GWALIOR, MADHYA PRADESH
IN THE MATTER OF:
Complainant:
Name: Krishna Singhal
Address: 556-b, Suresh nagar, thatipur, gwalior
Mobile No.: 6260299110
Email: krishnasinghal.1918@gmail.com
VERSUS
OPPOSITE PARTY:
TheTime24 / TheTime24.shop
Website: TheTime24.shop
Email/contact details displayed by the website: TheTime24.shop@gmail.com
Address: address is not provided
SUBJECT:
Complaint regarding delivery of an entirely different and unusable product instead of the watch ordered and paid for, non-availability/non-functioning of customer support, failure to provide an effective return/refund mechanism, and request for refund, compensation and other appropriate relief.
MOST RESPECTFULLY SUBMITTED:
1. That the Complainant is a consumer who placed an online order through the Opposite Party's website, TheTime24.shop, on 25 September 2026.
2. That the Complainant ordered a watch described/listed as “Omega Jumbo Chronograph Pre Cal. 321 Rose 1944” through the Opposite Party's website.
3. That the Complainant paid a total consideration of ₹1,709.10 for the said order.
That the order was delivered to the Complainant on 1 October 2026.
4. That upon receiving and opening the parcel, the Complainant found that the parcel did not contain the watch that had been ordered and paid for.
5. Instead of the ordered watch, the parcel contained cut pieces of clothes/fabric of no apparent use, which were completely unrelated to the product ordered.
6. The product received was therefore not merely defective or damaged; it was entirely different from the product purchased and advertised by the Opposite Party.
7. The Complainant immediately sought to exercise his right to return the product and obtain a refund.
8. The Opposite Party's website itself represents that customers may request a return within 7 days of receiving an order and states that approved refunds are to be processed after the returned item is received and inspected.
9. However, despite the existence of the stated return/refund policy, the Complainant has been unable to obtain effective customer support. The Complainant found the provided contact mechanism to be ineffective, including an invalid/non-functional email/contact channel, and there was no effective customer-care number through which the Complainant could resolve the issue.
10. The Complainant has therefore been placed in a position where he has paid ₹1,709.10 for a watch but has received only cut pieces of clothing/fabric and has not been provided with an effective mechanism to obtain the promised return and refund.
The Complainant submits that supplying an entirely different product from the one ordered and failing to provide an effective mechanism for resolving the resulting consumer grievance constitutes a serious consumer dispute and may amount to deficiency and/or unfair trade practice, as applicable under the Consumer Protection Act, 2019. The Act provides consumer remedies including refund, replacement, compensation and costs in appropriate cases.
11. The Complainant has suffered financial loss, inconvenience, harassment, loss of time and mental agony as a result of the transaction and the failure to provide an effective resolution.
12. The Complainant has preserved relevant evidence relating to the transaction, including the order details, payment record, delivery information, photographs/videos of the package and its contents, and evidence relating to attempts to contact the Opposite Party.
13. The cause of action arose upon delivery of the incorrect product on 1 October 2026 and continues due to the failure to provide an effective return and refund.
RELIEFS / PRAYER
In view of the facts stated above, the Complainant respectfully prays that this Hon'ble Commission may kindly:
A. REFUND
Direct the Opposite Party to provide the Complainant a full refund of ₹1,709.10, being the amount paid for the product that was not supplied.
B. RETURN OF WRONG PRODUCT
Direct the Opposite Party to arrange the return/pickup of the wrongly delivered cut pieces of clothing/fabric at its own cost, without requiring the Complainant to bear any return expense.
C. COMPENSATION
Award appropriate compensation to the Complainant for the mental agony, inconvenience, harassment and loss of time caused by the delivery of an entirely different product and the subsequent failure to provide an effective resolution.
D. LITIGATION / COMPLAINT EXPENSES
Award appropriate costs incurred by the Complainant in pursuing this consumer complaint.
E. APPROPRIATE DIRECTIONS
Pass any other order or direction that this Hon'ble Commission considers appropriate in the facts and circumstances of the case.
The Consumer Protection framework expressly permits Consumer Commissions to grant remedies including refund of the price paid, compensation for loss or injury, discontinuance of unfair trade practices and costs.
