In view of the facts stated above, the complainant respectfully prays that this Hon’ble Commission may kindly direct the opposite parties to:
a) Refund the remaining amount of ₹3,500 along with applicable interest;
b) Pay compensation of ₹5,00,000 towards mental harassment, financial loss, inconvenience, and deficiency in service;
c) Pay litigation expenses incurred by the complainant;
d) Pass any other order(s) deemed fit and proper in the interest of justice.
- That the complainant booked a TV repair service through Flipkart using registered mobile number 8712320511.
- That on 12 January 2026, the service engineer, Mr. Garugu Nagendra Kumar, collected the complainant’s TV for repair purposes.
- That thereafter, the complainant was instructed to pay a total amount of ₹7,000 (₹6,500 + ₹500) towards repair charges, which was paid in good faith.
- That despite waiting for more than four months and making repeated follow-ups, the TV was returned to the complainant without any repair being completed.
- That Mr. Jagadeesh, Technical Officer at the Srikakulam branch, refunded only ₹3,000. However, the remaining amount of ₹3,500 has not been refunded despite repeated requests and follow-ups.
- That both Mr. Garugu Nagendra Kumar and Mr. Jagadeesh failed to provide proper updates and remained unresponsive to calls and messages for a considerable period.
- That the conduct of the opposite parties amounts to clear deficiency in service, negligence, unfair trade practice, mental harassment, unnecessary delay, and financial loss to the complainant.
- That the complainant has preserved all relevant evidence, including payment receipts, communication records, and service-related details, which can be produced before this Hon’ble Commission.
In view of the facts stated above, the complainant respectfully prays that this Hon’ble Commission may kindly direct the opposite parties to:
a) Refund the remaining amount of ₹3,500 along with applicable interest;
b) Pay compensation of ₹5,00,000 towards mental harassment, financial loss, inconvenience, and deficiency in service;
