SUBJECT: Complaint for refund of ₹5000 due to unfair trade practice, misrepresentation, and deficiency in service
RESPECTFULLY SHOWETH:
GROUNDS:
A. Because the Opposite Party misrepresented key facts (batch timing and demo classes).
B. Because the Complainant was not given fair opportunity to understand contractual terms.
C. Because no service was actually provided or utilized.
D. Because the conduct of the Opposite Party is arbitrary, unfair, and against consumer rights.
PRAYER:
In light of the above, the Complainant respectfully prays that this Hon’ble Commission may kindly:
a) Direct the Opposite Party to refund ₹5000 to the Complainant.
b) Award compensation for mental harassment and inconvenience (₹10,000 or as deemed fit).
c) Award litigation costs.
d) Pass any other order deemed fit in the interest of justice.

SUBJECT: Complaint for refund of ₹5000 due to unfair trade practice, misrepresentation, and deficiency in service
RESPECTFULLY SHOWETH:
- That the Complainant enrolled with the Opposite Party by paying an amount of ₹5000 as a booking amount for admission.
- That prior to payment, the Complainant was clearly assured by the counselor that:
a) Classes would be conducted in the morning batch.
b) No demo classes were available. - That after payment, the Opposite Party:
a) Denied the availability of morning classes and offered only evening classes.
b) Provided demo classes to other students who had not paid any amount, which contradicts their earlier statement. - That the Complainant was pressured to accept and sign the terms and conditions without being given adequate opportunity to read and understand them, thereby vitiating free consent.
- That the Opposite Party also induced the Complainant by offering additional scholarship benefits in exchange for bringing more students, which amounts to an unfair trade practice.
- That despite payment, no proper communication, onboarding, or service details were provided to the Complainant.
- That due to the above reasons, the Complainant did not attend any classes, and no service was availed.
- That the act of the Opposite Party amounts to:
- “Deficiency in service” as defined under Section 2(11) of the Consumer Protection Act, 2019 (any fault, imperfection, or inadequacy in the quality or manner of performance).
- “Unfair trade practice” under Section 2(47) of the Consumer Protection Act, 2019 (including misleading representations and false promises).
- That the clause of “non-refundable amount” cannot be enforced as it was obtained under pressure and without proper disclosure, and also because the service promised was not provided.
