Respected Sir/Madam,
I am filing this complaint under the Consumer Protection Act, 2019 against Flipkart for deficiency in service and unfair trade practices.
Facts of the Case
1. I placed an order on Flipkart bearing Order ID: OD437724051329704100 for iBELL IBL M220-76 ARC Welding Machine 220A Portable IGBT Welder.
2. At the time of purchase, Flipkart assured delivery on 04 June 2026. Based on this commitment, I proceeded with the purchase.
3. However, Flipkart failed to deliver the product on the promised date and ultimately delivered it on 06 June 2026, causing inconvenience and loss of time.
4. Upon receiving the product, I discovered that the welding machine was defective and not functioning properly.
5. I immediately reported the issue and requested a replacement through Flipkart’s customer support system.
6. Despite acknowledging my replacement request, Flipkart failed to provide the replacement within a reasonable time. As of 15 June 2026, the replacement had still not been delivered.
7. Due to the excessive delay and uncertainty, I was compelled to purchase the same product from an offline market to meet my urgent requirements.
8. As a result of Flipkart’s failure to deliver a working product within the promised timeframe, I suffered financial loss, mental harassment, inconvenience, and loss of trust.
Grounds for Complaint
* Deficiency in service by delaying delivery beyond the promised date.
* Supply of a defective product.
* Failure to provide timely replacement after accepting the defect claim.
* Mental harassment and inconvenience caused to the consumer.
* Unfair trade practice by failing to honor delivery and replacement commitments.
Reliefs Sought
I respectfully pray that this Hon’ble Commission may:
1. Direct Flipkart to accept the return of the defective product and issue a full refund of the purchase amount.
2. Award compensation of ₹25,000 (or such amount deemed fit by the Hon’ble Commission) for mental agony, inconvenience, and harassment caused.
3. Award litigation costs and expenses incurred in pursuing this complaint.
4. Pass any other order deemed just and proper in the interest of justice.
