Subject: Complaint Regarding Defective Product, Deficiency in Service, and Denial of Refund
I, the complainant, respectfully submit the following facts:
- On 28th December, I purchased a Lucknowi Chikankari kurti from the opposite party.
- Upon taking the product home, I discovered that the kurti was torn due to poor quality workmanship, rendering it unfit for use. This clearly amounts to the sale of defective goods.
- I returned the defective product via courier on 30th December, bearing the inconvenience and effort in good faith, expecting a proper resolution.
- Without any prior notice or confirmation, the opposite party sent a replacement on 3rd January, which was delivered to the local DTDC office, causing further inconvenience and repeated follow-ups on my part to trace the parcel.
- Upon receipt and inspection of the replacement product, I found that it was unfinished, of extremely poor quality, and not wearable. This was the second defective item supplied by the opposite party.
- I requested a refund, as I no longer had confidence in the quality of the products. However, the opposite party refused to provide a refund or replacement, despite supplying defective goods twice.
- I have clearly communicated my willingness to return the item in unused condition, yet the opposite party continues to deny a refund. This constitutes deficiency in service, unfair trade practice, and harassment of the consumer.
Relief Sought
I respectfully request the Honorable Consumer Forum to direct the opposite party to:
- Provide a full refund of the amount paid for the product
- Compensate me for mental harassment and inconvenience caused
- Reimburse any courier or incidental expenses incurred
- Pass any other order deemed fit in the interest of justice
