I am filing this complaint against Tirumala Cooperative Bank Malakpet Branch for serious deficiencies in service, non-transparent loan handling, illegal restructuring pressure, wrongful charges, harassment, and hiding important loan documents. Their actions have created mental stress and financial difficulty for my family, especially because my father recently suffered a brain stroke.



Details of the Complaint

1. Loan details and payments made

In 2019, we took a mortgage loan of ₹12 lakhs.
Since then, we have paid around ₹10 lakhs through regular EMIs.

2. COVID job loss and business shutdown

During COVID, I lost my job and our family business suffered severe losses.
Due to this, some EMIs were missed, but we always informed the bank.

3. Request for restructuring denied – instead forced into illegal new loan

When we requested restructuring as per RBI hardship guidelines, the bank refused and forced us to take a new loan of ₹15 lakhs for 15 years.

They also said:
• The ₹10 lakhs we already paid since 2019 would be wiped out.
• A fresh loan file will replace the old loan.
• Past payments will not be shown anywhere.
• ₹15 lakhs will be adjusted towards closing the old loan internally.

This clearly looked like an attempt to erase evidence of their mistakes, avoid accountability, and trap us into a bigger loan.

4. I missed EMIs but that does not mean cheating

I want to clearly state that missing EMIs due to COVID job loss, business loss, and medical hardship does not mean I am cheating any financial institution.
I have always continued paying whenever possible and am still paying the original EMI amount regularly.

5. Harassment by CEO and staff

On 29-08-2024, the CEO Mr Shobanadri and staff member Mr Manipal Reddy came to our house, shouted publicly, and humiliated us in front of neighbors.
This is a clear violation of RBI Fair Recovery Practices.

6. Father’s brain stroke ignored

Recently my father suffered a brain stroke and was hospitalized.
We submitted medical proofs and requested temporary relief, but the bank ignored everything and continued harassment and issued notices.

7. Bank marked NPA wrongfully

Even though we are continuing to pay EMIs, they marked the account as NPA without considering COVID hardship, job loss, or medical emergency.

8. Bank did not provide basic documents
• No loan agreement was given.
• ₹30,000 taken for shares but no certificate or dividend record given.
• Insurance premium deducted from loan but no insurance documents provided.
This is a violation of RBI rules.

9. Wrong CIBIL reporting

The bank incorrectly reported two active loans, damaging our CIBIL score.
They later said it was a “server mistake.”

10. Illegal charges

The bank is charging ₹5,000 per legal notice from our loan account without any justification.

11. Excess and unexplained penal interest

Even in months when payments were made, the bank added penalty interest.
Because of this manipulation, the outstanding amount keeps increasing.



Current Situation

I am regularly paying the original EMI amount.
But the bank is:
• Showing increasing outstanding
• Adding unexpected charges
• Not considering our hardship
• Not giving transparent loan statements

Because of the wrong NPA and CIBIL remarks, no bank is willing to take over our loan.



Relief Requested

I respectfully request the Honorable Consumer Court to please do the needful and:
1. Direct the bank to provide all missing documents (loan agreement, insurance papers, share certificate).
2. Correct the loan account and remove wrongful charges and wrongful NPA marking.
3. Provide a clear, transparent loan statement with correct outstanding.
4. Instruct the bank to stop harassment and follow RBI Fair Practice Code.
5. Give us a proper and fair option to clear total dues through a structured EMI plan considering our genuine hardship and my father’s health condition.
6. Ensure the bank does not force illegal restructuring or wipe out our paid amounts.
