This complaint is filed against State Bank of India regarding unauthorized recovery of loan EMIs after the death of the borrower. The original loan amount was approximately ₹1,55,500. After the borrower passed away, the bank was officially informed, and the death certificate was submitted. Despite this, SBI continued to recover EMIs and illegally deducted approximately ₹60,000 from the account of the deceased.

This constitutes:

Gross negligence and deficiency in service

Violation of RBI guidelines

Unauthorized debit from the deceased’s account

Financial loss to the legal heir

Severe mental harassment, stress, and emotional trauma to the family


Due to the above illegal and negligent actions, I am claiming the following reliefs and compensation:

1. Immediate refund of the illegally deducted amount (₹60,000 approx.)


2. Compensation for financial loss caused due to unauthorized deduction (₹3,00,000 approx., i.e., 5× the illegally deducted amount)


3. Compensation for mental harassment, emotional distress, and mental torture suffered by the legal heirs (₹1,00,000 – ₹2,00,000 approx.)


4. Interest on the illegally deducted amount from the date of deduction until full refund


5. Penalty and strict action against the responsible officials of SBI for negligence, harassment, and violation of banking regulations


6. Any other relief deemed appropriate by the Consumer Court / RBI Ombudsman



I request the authority to ensure full refund, maximum compensation for harassment and mental torture, and strict enforcement of banking regulations to prevent such incidents in the future.
