I, Ashok Kumar Pradhan, a resident of Jamukoli, Panchagaon, Air Field BBSR,Khorda,Odisha-752050, hereby file this complaint against Flipkart Internet Private Limited, registered at Flipkart’s Registered Address: Buildings Alyssa, Begonia & Clove Embassy Tech Village, Outer Ring Road, Devarabeesanahalli Village, Bengaluru, Karnataka 560103, for deficiency in service, unfair trade practices, and harassment under the Consumer Protection Act, 2019.
Details of the Complaint: Purchase Details: On May 6, 2025, I placed an order for a KELOSK Bus Shape Metal Pencil Box through Flipkart’s online platform (Order ID: OD434336691843626100). The product was delivered to my address on May 11, 2025.
Issue with Delivery: Upon receipt, I found the product to be damaged and unfit for use. The damage was evident and not caused by me or my family, as the item was inspected immediately upon delivery.Replacement Request: Within two hours of delivery, I raised a replacement request through Flipkart’s portal, adhering to their return and replacement policy, expecting a prompt resolution.Denial of Replacement: On May 16, 2025, Flipkart’s delivery personnel visited my residence for the replacement but refused to process it, citing that the item was “used.” This claim is baseless, as the product was delivered in a damaged condition and was not used due to its defective state.
Impact and Harassment: Flipkart’s delivery of a damaged product, coupled with the unjust denial of replacement, constitutes a deficiency in service and unfair trade practices. This ordeal has caused significant inconvenience and emotional distress to me and my child, who was eagerly awaiting the pencil box for school use. The unprofessional conduct of Flipkart and its delivery personnel has led to harassment, violating my consumer rights.
Relief Sought: I respectfully request Flipkart to: Immediately replace the damaged KELOSK Bus Shape Metal Pencil Box with a new, undamaged product. Pay compensation of INR 10,000 for the mental agony, harassment, and emotional distress caused to me and my child. Refund the full amount paid for the product INR 257 along with bank interest , if replacement is not feasible. Cover litigation costs incurred in filing this complaint. Take strict action against Flipkart for their deficient service and unfair trade practices.
