Complaint Against Defective Product Delivery, Misrepresentation, and Denial of Refund

I, the undersigned, wish to lodge a formal complaint against the seller/platform regarding a highly unsatisfactory and unfair consumer experience involving the delivery of a Philips trimmer.
The product was marked as an open-box delivery. However, upon inspection at the time of delivery, I observed that the packaging was severely damaged and tampered with. More concerning was the condition of the product itself, which appeared to have been previously used and was visibly covered with hair, rendering it unhygienic and unacceptable for use.
Considering the condition of the product, I rightfully refused to accept the delivery. Subsequently, I contacted the customer support team, where the executive advised me to share an OTP to initiate the cancellation and return process. Acting in good faith and based on this instruction, I shared the OTP. However, the delivery executive left immediately thereafter, and I was later informed that the return request could not be processed solely because the OTP had been shared.
This sequence of events indicates clear misrepresentation, negligence, and an apparent attempt to mislead and exploit the consumer. I have retained and submitted all relevant evidence, including photographs, videos, and screenshots, clearly demonstrating the defective and used condition of the product at the time of delivery.
Despite promptly raising the issue, the resolution provided has been inadequate and unjust. The refusal to process the return and refund based on a technicality, especially when the OTP was shared under the guidance of the company’s own representative, is arbitrary and unfair.
I respectfully request the Hon’ble Consumer Forum to:
- Direct the opposite party to process a full refund of the amount paid.
- Take appropriate action against such unfair trade practices and deficiency in service.
- Provide compensation for the mental distress, inconvenience, and time loss caused due to this incident.

I seek an urgent and fair resolution to this matter.
