SUBJECT

Complaint regarding Deficiency in Service, Unfair Trade Practice, Misrepresentation, False Promises and Non-Refund of ₹82,000/- by Saumic Craft.
MOST RESPECTFULLY SHOWETH:
I, Anand Diwakar, the complainant herein, respectfully submit this complaint against the Opposite Party for adopting unfair trade practices, making false representations, providing deficient services and refusing to refund an amount of ₹82,000/-, thereby causing severe financial loss, mental harassment and business loss.
FACTS OF THE CASE
The complainant came across the Instagram page of Saumic Craft, where the Opposite Party advertised that individuals could start a successful Amazon Dropshipping Business under their B2B Business Model with "Zero Investment" and complete business support.
Believing these representations to be genuine, the complainant contacted the Opposite Party. During telephonic discussions and promotional webinars, the representatives assured that they would provide complete assistance for establishing and operating an Amazon business.
The complainant was informed that an initial payment of ₹11,874/- was mandatory to obtain lifetime access to their services and that no further compulsory fee would be charged.
After receiving the payment, the Opposite Party shared a legal agreement and requested the complainant to sign it immediately. The important conditions of the agreement were explained only over telephone calls and were never properly disclosed in writing through WhatsApp or email, thereby preventing the complainant from making an informed decision.
Subsequently, during another webinar, the Opposite Party changed its earlier representation and stated that the complainant must opt for Amazon FBA by paying approximately ₹30,000/-, claiming that Amazon would provide incentives worth ₹45,000/- and that a dedicated KAMP Team would manage the complainant's social media accounts, create marketing content, generate organic traffic and increase product sales.
Relying upon these assurances and representations, the complainant invested a total amount of approximately ₹82,000/- towards Amazon-related services, business setup and associated charges as instructed by the Opposite Party.
Despite receiving the entire amount, the Opposite Party failed to deliver the promised services. Even after more than three months, the assured marketing support, social media management, business growth assistance and KAMP Team services have not been provided.
Whenever the complainant requested updates, the Opposite Party either avoided responding, ignored communications or kept making repeated assurances that the work would commence shortly, without actually providing the promised services.
The complainant also contacted members of the KAMP Team in Surat, who advised him to first complete FBA and create social media pages. However, even after complying with these instructions, no meaningful assistance or business support was provided.
More seriously, the complainant discovered that representatives of the Opposite Party had accessed his Amazon Seller Central account without his informed consent. Thereafter, advertising campaigns were allegedly operated, prices of FBA products were modified, and business decisions affecting the account were taken without the complainant's authorization.
As a result of these actions, the complainant's Amazon Seller Account suffered significant business losses, including fake or low-quality orders, increased return rates, delayed shipment performance and deterioration of account health, placing the seller account at serious risk of suspension/deactivation.
Due to the failure of the Opposite Party to provide the promised services and because of the financial loss suffered by the complainant, the complainant repeatedly requested cancellation of the services and refund of the entire amount of ₹82,000/-. However, the Opposite Party has wrongfully refused to refund the money.
The conduct of the Opposite Party clearly amounts to Deficiency in Service, Unfair Trade Practice, Misrepresentation and Unfair Commercial Conduct under the Consumer Protection Act, 2019.
CAUSE OF ACTION
The cause of action first arose when the Opposite Party induced the complainant through misleading representations and continued thereafter by failing to provide the promised services, refusing to refund the amount and causing continuing financial and business losses.

GROUNDS

The complaint is maintainable on the following grounds:
1.Deficiency in Service.
2.Unfair Trade Practice.
3. Misleading advertisements and false representations.
4. Failure to provide promised services after receiving consideration.
5. Wrongful retention of consumer's money.
6. Mental harassment and financial loss caused to the complainant.

PRAYER

The Complainant respectfully prays that this Hon'ble Commission may kindly be pleased to:
a. Direct the Opposite Party to refund the entire amount of ₹82,000/- to the complainant.
b. Award interest on the aforesaid amount from the date of payment until realization.
c. Award compensation for mental agony, harassment, business loss and financial hardship suffered by the complainant.
d. Award litigation expenses and costs of these proceedings.
e. Direct the Opposite Party to cease adopting unfair trade practices and misleading representations against consumers.
f. Pass such other and further orders as this Hon'ble Commission may deem fit and proper in the interest of justice.
