CONSUMER COMPLAINT​


Under Section 35 of the Consumer Protection Act, 2019

  1. Skechers India Private Limited
    (Having its registered office at - Unit No. G1, Ground Floor, Fulcrum A Wing, CTS No. 48 Sahar Road, next to Hyatt Regency, Andheri (East), Mumbai – 400099, India
  2. Skechers Exclusive Store
    Jaggi Shopping Center,
    Ambala City, Haryana



FACTS OF THE CASE:


  1. That the Complainant purchased a pair of Skechers shoes from the Opposite Party No. 2 (Skechers showroom at Jaggi Shopping Center, Ambala City) on 13 July 2025 for a consideration amount of ₹10,999, vide a valid invoice.
  2. That the shoes were purchased for personal use and not for any commercial purpose, hence the Complainant is a “consumer” under the Consumer Protection Act, 2019.
  3. The Complainant used the said shoes only during normal office hours in a controlled environment and there was no rough, excessive, or improper use whatsoever.
  4. That within less than six months of normal and careful use, the thread of one shoe started coming out, making the shoes unfit for further use. The defect clearly indicates poor quality and lack of durability, especially considering the premium price paid by the Complainant.
  5. That on 02 December 2025, the Complainant emailed the Opposite Party informing them about the quality issue and requested a suitable resolution such as replacement or refund.
  6. That the Opposite Party refused to provide any solution, stating that there was no manufacturing defect and that the warranty period was only three months. The Opposite Party failed to appreciate that the issue is of poor quality and durability, and not merely a manufacturing defect.
  7. That the Complainant further tried to contact the customer care number provided by the Opposite Party, however the number never connects, which caused great inconvenience and harassment to the Complainant.
  8. That the refusal to provide any resolution despite a clear quality failure, and the non-functional customer care support, amounts to deficiency in service and unfair trade practice.
  9. That shoes costing ₹10,999 are reasonably expected to last for a reasonable period, and failure within six months renders the product defective and unfit for use.
  10. That the Complainant has suffered financial loss, mental harassment, and inconvenience, and has been left with shoes which are of no use.



CAUSE OF ACTION:


The cause of action first arose on 02 December 2025 when the Complainant reported the issue and continues till date as the Opposite Parties have failed to resolve the grievance.




JURISDICTION:


This Hon’ble Commission has jurisdiction to entertain the present complaint as:
  • The product was purchased from Ambala City
  • The cause of action arose within Ambala
  • The claim amount is within the pecuniary jurisdiction of this Hon’ble Commission



RELIEF SOUGHT:


The Complainant respectfully prays that this Hon’ble Commission may be pleased to:

a) Direct the Opposite Parties to refund ₹10,999 paid by the Complainant
OR alternatively provide a new replacement pair of shoes of the better quality.

b) Award compensation of ₹20,000 for mental agony, harassment, and inconvenience caused;

c) Award litigation costs incurred by the Complainant;

d) Pass any other order(s) as this Hon’ble Commission may deem fit in the interest of justice.
