A leakage/seepage in common bathroom and in Master Bed Bathroom of my newly purchased Flat in Lodha BelAir, Tower F, Flat No. 1006, Patel Estate Road, Jogeshwari West, Mumbai 400102, started on 23rd November 2023.

  • On 23rd November 2023 I lodged a complaint (No. 17705 dated 23-11-2023) through Developers App (My Lodha) for leakage/seepage in common bathroom.
  • 27th November 2023 lodged complain for Leakage in my Master Bed Bathroom.
The developer (Macrotech Developers Ltd) claims that leakage is due to the modification carried out by the above flat owner therefore, their (Developer) warranty becomes null and void and they will not do any repair works.

In my opinion and what I have observed these leakage/seepage is due to the subpar workmanship by Developer (Macrotech Developers Ltd) and due to the modification by above flat owner. Both are equally responsible for these leakage/seepage.

Thereafter, several emails, telephone conversation and WhatsApp messages exchanged between developer’s (Macrotech Developers Ltd) representatives (Neeraj Sing, Ajay Kumar, Sunil Pujari etc.) and Qamar Ali (flat owner of above my flat) and myself (few of them I am attaching for your ready reference.)

Some patch up works have been done by developer’s fitout section and some water proofing work done by the above flat owner but the leakage/seepage remains unresolved infact till writing of this complainthe leakage/seepage continues and worsen. It damages my electrical wiring, lights, tiles and false ceiling.

I need either Developer or above flat owner or both of them rectify this leakage/seepage and compensate my loses.

We suggest you to first send a legal notice to the owner of the flat above you.
