I, the Complainant above named, respectfully submit as follows:
1. Facts of the Case
PRAYER
In view of the above facts and circumstances, I respectfully pray that this Hon’ble Commission may be pleased to:
a) Direct the Opposite Party to refund the entire amount paid by me along with applicable interest;
b) Award compensation for financial loss, including loan interest and rent paid, caused due to delay and non-supply of materials;
c) Award compensation for mental agony and harassment suffered by the Complainant;
d) Award costs of the complaint; and
e) Pass such other or further orders as this Hon’ble Commission may deem fit and proper in the interest of justice.
1. Facts of the Case
- That I am a consumer as defined under the Consumer Protection Act, 2019 and the Opposite Party is engaged in the business of supplying interior materials and services.
- That on 20.11.2025, I obtained a quotation from the Opposite Party, M/s Pyramid Interior Solutions, Nizampet, Hyderabad, for the supply of rafters, moulding and adhesive required for interior works of my residential house.
- That based on the said quotation, I made full payment through PhonePe to the Opposite Party. In addition to the quoted amount, the Opposite Party also collected extra charges towards tax and courier charges, assuring timely delivery of the material.
- That despite receipt of the full amount, the Opposite Party failed to supply the materials as promised and did not adhere to the agreed timeline.
- That I made several oral requests and follow-ups with the Opposite Party. However, the Opposite Party neither supplied the material nor refunded the amount paid, thereby showing complete negligence and disregard towards the consumer.
- That due to the failure of the Opposite Party to supply the materials, my interior work has been kept pending for more than three months.
- That my interior work contractor was compelled to abandon the work, as he could not wait indefinitely for the supply of materials, resulting in severe disruption of my house construction schedule.
- That due to the said acts of the Opposite Party, I have suffered substantial financial loss, including:
- Interest on the housing loan obtained for the said property
- Rent being paid for alternative accommodation due to delay
- Additional expenses due to discontinuation of interior work
- Severe mental agony, stress, and harassment
- That the acts of the Opposite Party amount to deficiency in service and unfair trade practice under the Consumer Protection Act, 2019.
- The cause of action arose on 20.11.2025 when the payment was made and continues till date as the Opposite Party has failed to deliver the material or refund the amount.
- This Hon’ble Commission has jurisdiction to entertain the present complaint as the Opposite Party carries on business within its territorial jurisdiction and the cause of action arose therein.
In view of the above facts and circumstances, I respectfully pray that this Hon’ble Commission may be pleased to:
a) Direct the Opposite Party to refund the entire amount paid by me along with applicable interest;
b) Award compensation for financial loss, including loan interest and rent paid, caused due to delay and non-supply of materials;
c) Award compensation for mental agony and harassment suffered by the Complainant;
d) Award costs of the complaint; and
