### Facts of the Case:
1. The complainant booked a travel package with **Thrillophilia** on 12th August 2025 for a trip to Vietname, at an agreed cost of **₹3,29,509( gave 5k discount on top of this amount which is not documented and was a verbal communication) inclusive of internal flights, visa, hotel accommodations, activities, and transfers.
2. However, during the payment process, I was provided a separate link for the land package amounting to ₹2,81,440, with an assurance that a different link would be shared for booking the domestic flights.
3. Based on the confirmation provided, I proceeded with the payment of first installment 30% of ₹2,81,440= **₹84,432.15** at the time of bookingas per the paymnet plan.
4. And as per the amount we finally agreed on, the remaining amount ₹48,069 (i.e., ₹3,29,509 - ₹2,81,440) should be utilized for domestic flights.
5 Subsequently, Thrillophilia **increased the cost of the package by approx. ₹50,000–₹60,000**, due to increased rates of doemstic flights which were never disclosed earlier.
6. As a resolution, Thrillophilia offered a **revised package at ₹3,49,509 (exclusive of applicable taxes)**, admitting that the earlier miscalculation was from their side. However, after adding **18% GST and flight-related taxes**, the actual cost escalated to nearly **₹90,000 more**, whereas as per the original plan the additional cost for internal flights should have been only **₹48,000**.
7. This lack of transparency left the complainant with **no option but to discontinue the trip**. However, Thrillophilia **denied refund**, despite the escalation being entirely due to their own mismanagement and delay.
8. To make matters worse, Thrillophilia enforces a **misleading cancellation/refund policy**:
* In case of **partial payment**, no refund is given.
* In case of **full payment**, refund is also denied.
This effectively traps the customer at every stage, which is **arbitrary, one-sided, and amounts to unfair trade practice under Section 2(47)**.
9. Importantly, this was the **complainant’s first international trip planned with parents**. Due to Thrillophilia’s mismanagement, the complainant went through **severe stress and disappointment**.
10. I had already booked **non-refundable international flight tickets** separately, and therefore was compelled to make fresh arrangements with another trip advisor within the budget. This caused **additional financial burden and mental harassment**.
11. This cancellation was not due to any personal reason of the complainant but solely due to the issues and non-transparency at **Thrillophilia’s side**.
12. The complainant has preserved all **evidence of communication, booking confirmations, payment receipts, and emails** with Thrillophilia, which are annexed with this complaint.

### Grounds of Complaint:
The Opposite Party is liable under the following provisions of the Consumer Protection Act, 2019:
* **Section 2(11):** Deficiency in service – failure to honor the agreed package cost and poor handling of bookings.
* **Section 2(47):** Unfair trade practice – misleading refund terms and unjustified cost escalation.
* **Section 2(9):** Violation of consumer rights – denial of transparency and the right to fair redressal.
* **Section 49/59:** Jurisdiction of District/State Commission depending on claim amount.

### Reliefs Sought:
In view of the above, the complainant prays that this Hon’ble Commission may kindly direct the Opposite Party to:
1. **Refund the entire amount of **₹\84,432.15** along with interest @9 per annum from the date of payment till realization.
2. **Compensate the complainant for mental harassment and financial loss** by awarding **₹100000* in damages.
3. Declare the **“No Refund Policy”** of Thrillophilia as **unfair, arbitrary, and void** under the Consumer Protection Act, 2019.
4. Direct Thrillophilia to **bear the litigation cost** of these proceedings.
5. Pass such other order(s) as this Hon’ble Commission may deem fit in the interest of justice.
