We refer to Order No. 212942153036248 with SWIGGY FOOD DELIVERY APP., for Food Value of Rs. 212/- (food value Rs. 134.76 and delivery cum platform value of Rs. 56.80 plus taxes.).
The order was placed @ 20:06 on 31st July 2025. The food was supposed to be delivered within 25 minutes max. But there was no notification of delivery till 20:38 hrs., till we alerted the Customer Service.
The automatic chatbots gave vague replies and sorry messages and finally transferred to human agent only by 20:43 hrs. Till then even the delivery partner was not even allotted.
Finally when the Customer Service agent attended the call, he said he will allot a delivery agent, but when we asked for cancellation of the order, he put the call on hold and finally disconnected the call without any response.
Finally we had to close the app by 20:50 hrs, with option to cancel the delivery on penalty basis or forced to accept the late delivered food.
So, SWIGGY having failed ro deliver the food on time and not having resolved our grievance properly, have no riight to forfeit our money of Rs. 212.00. So it must be refunded inasmuch as they failed to deliver the food on time. Food cannot be accepted on delayed basis, as it has a time value
