CONSUMER COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019

FACTS OF THE CASE:

The complainant states that she purchased a one-year gym membership for her husband Mr. G. Prem Kumar from the opposite party, SKALE Fitness – Anna Nagar East Branch, by paying a total sum of ₹8,000 on 30-12-2024. The membership commenced on 02-01-2025.

The said membership was taken specifically based on the assurance of service and the proximity of the Anna Nagar East branch, which was convenient for regular usage.

The complainant’s husband was able to utilize the gym facilities for only about two months. Thereafter, the opposite party closed the gym citing renovation and later permanently shut down the branch without any prior notice or intimation to the members.

The sudden closure of the gym caused severe inconvenience, financial loss, and mental agony to the complainant and her husband, as the service paid for was not rendered.

In an attempt to resolve the issue, the complainant personally visited other branches of SKALE Fitness, including Kilpauk and Chinmaya Nagar branches, as directed by the staff. However, no authorized person was available during repeated visits, and no written response, refund, or alternative gym arrangement was provided.

The opposite party assured that the refund would be processed within 7 days, but no refund has been made till date, despite repeated follow-ups.

The complainant issued a formal refund notice via email dated 20-12-2025, clearly stating that legal action would be initiated if the refund was not processed within 7 days. However, the opposite party failed to respond.

The complainant also approached the National Consumer Helpline and lodged a grievance bearing Grievance Number: 8367447, which is currently shown as In Process. Despite this, the opposite party has neither refunded the amount nor resolved the issue.

The acts of the opposite party clearly amount to deficiency in service, negligence, and unfair trade practice, as defined under the Consumer Protection Act, 2019.

The complainant is therefore constrained to approach this Hon’ble Commission seeking appropriate relief.

CAUSE OF ACTION:

The cause of action arose on 30-12-2024, when the payment was made, and continues thereafter due to the closure of the gym and failure of the opposite party to refund the unused membership amount.

RELIEF SOUGHT:

The complainant respectfully prays that this Hon’ble Commission may be pleased to:

a) Direct the opposite party to refund ₹6,667 after deducting charges for two months’ usage
b) Direct the opposite party to pay ₹10,000 as compensation for mental agony and inconvenience
c) Direct the opposite party to pay ₹5,000 towards litigation expenses
d) Pass any other order or relief deemed fit in the interest of justice
