Hello @nanigopalkirttaniya

I'm sorry to hear about the difficulties you're facing in obtaining your child's Transfer Certificate (TC). Under Indian law, schools are obligated to issue TCs promptly upon request, and withholding them—especially due to fee disputes—is considered a violation of the Right to Education (RTE) Act, 2009. Here's a structured approach to help you resolve this issue:

🛠️ Steps to Obtain the Transfer Certificate

1. Submit a Formal Written Request
  • Draft a formal letter addressed to the school's principal or headmaster requesting the immediate issuance of the TC.
  • Clearly state that withholding the TC is against Section 5(3) of the RTE Act, which mandates the issuance of TCs without delay.
  • Submit the letter via registered post or email and retain a copy for your records.
2. Engage the School Management
  • If there's no response within a week, escalate the matter to the school's management or governing body.
  • Request a written explanation for the delay or refusal to issue the TC.
3. Approach Educational Authorities
  • Block Education Officer (BEO): File a complaint with the BEO of your area, detailing the school's non-compliance.
  • District Education Officer (DEO): If the BEO doesn't resolve the issue, escalate it to the DEO.
  • Provide all relevant documents, including your written requests and any responses received.
4. Contact the School's Affiliation Board
  • CBSE Schools: If the school is affiliated with CBSE, you can lodge a complaint through the CBSE's official portal.
  • State Board Schools: Reach out to the respective state education board with your grievance.
5. Send a Legal Notice
  • If the school remains unresponsive, consult a lawyer to draft and send a legal notice demanding the issuance of the TC.
  • This notice should highlight the school's obligations under the RTE Act and any potential legal consequences of non-compliance.

📌 Legal Precedents and Rights

  • The Madras High Court has ruled that schools cannot withhold TCs due to fee disputes, emphasizing that such matters should be resolved separately without affecting a student's right to education.
  • The National Commission for Protection of Child Rights (NCPCR) has clarified that under the RTE Act, no school can refuse to provide a TC, ensuring that children's education is not disrupted.
