Subject: Compliant against Punjab National Bank Ismailabad Kuruchetra District Haryana

This is brought to your kind notice that the applicant is duly authorized and power of attorney holder for and on behalf the account holder's of the above said bank having the fixed deposits in the above said Bank. Since the account holder's (Mr. Sunjay Kaushal, Mr. Shalesh Kaushal, Rainu Kaushal and Mrs. Kamla Kaushal) are of foreign nationals residing in USA, they have duly executed the Power of Attorney in favor of the Complainant to effect the transfer of funds from Punjab National Bank to USA Account.

First of all, the Complainant wish to bring in your kind notice that this transaction is started on 28.03.2024 when first time Complainant has visited the PNB Ismailabad Branch and the bank manager was Mr. Ravi Kumar. He has explained us the list of documents particularly Power of Attorney (“POA”) will be required. Since the POA were required to be executed and attested in USA first therefore it took time. Further, on 05.04.2024 when Complainant had conversation with Mr. Ravi regarding attestation of POA, Mr. Ravi Kumar has further explained to get it attested from the concerned authority and also convey the massage that he has been transferred from PNB Ismailabad Branch and need to contact to the new branch Manager Mr. Sanjeev and its second time when Complainant has visited the PNB Ismailabad Branch on 14.10.2024. At the meeting, The Branch Manager, Mr. Sanjeev Kumar told us that funds can be transferred only to NRO account and you need to first open the NRO account. Post this we have opened the NRO account for all the FD’s holder which has taken 5-6 month to complete the formalities. The fact was well known to Bank Manager that NRO account opening will take time and that’s why taken the advantage to hold funds. Till our visit no legal opinion has been sought because they put the point of NRO account and till the time all POA were ok. Please refer below the dates of our visit and chats over the whatsapp wherein all the visits are duly recorded:
1. First Visit on 28.03.2024 met with Mr. Ravi Kumar, Branch Manager;
2. Second Visit on 14.10.2024 met with Mr. Sanjeev Kumar, Branch Manager;
3. Third Visit on 18.03.2025 met with Mr. Sanjeev Kumar, Branch Manager;
4. Fourth Visit 20.03.2025 met with Mr. Sanjeev Kumar, Branch Manager (along with Mr. Sunjay Kaushal, Mr. Shalesh Kaushal and Mrs. Kamla Kaushal)
5. Fifth Visit to Panipat and Mr. Sanjeev Kumar has come over their on 26.03.2025 (Along with Mrs. Rainu Kaushal)

It is further submitted that when the Complainant has completed all the formalities of opening of NRO Account and duly executed and attested Power of Attorney. Please refer the email dated 17.02.2025 which was responded on 11.03.2025 and what was the response “kindly visit the branch” and at branch what they said “मै कैसे मानु की जिसने पावर ऑफ़ अटॉर्नी साइन की है वो जिन्दा है की नही आप उन सबको लेकर आओ तभी काम हो पायेगा”. All the time branch manager has tried to avoid the transaction. It was well known to the Branch Manager that FD’s holder have the NRO account in his branch itself still he misguided to open the NRO account. Why we have opened the NRO account in ICICI Bank while we already have the NRO Account with PNB. Later on when the Branch Manager feel that now there is no option to hold the funds he has offered us to transfer the FD’s in PNB NRO Account. What is the definition of proper due diligence. As per Mr. Sanjeev Kumar, Branch Manager, due diligence was “मै कैसे मानु की जिसने पावर ऑफ़ अटॉर्नी साइन की है वो जिन्दा है की नही आप उन सबको लेकर आओ तभी काम हो पायेगा” This was the statement and due diligence made by your bank. They ignored all the rules of POA which was duly attested in USA and in India as well. And my colleague is witness of this statement. They were playing the tactics of holding the funds.

Please be submitted that post our visit to the Branch on 18.03.2025 when the Branch Manager has denied to transfer the funds then we had words with the POA Holder on 18.03.2025 and POA holder has agreed to visit to Ismailabad because there was no option left with the POA Holder and they had to prove that they are alive and the POA has been executed by themselves only. They have visited India to prove that all the attestation of USA Attorney are not fake and Indian Stamp authority are not fake because only PNB is doing due diligence to lingering the transaction and to hold the funds unauthorized. The only reason none of the NRI wants to maintain accounts with these corrupted banks.

The Branch Manager has asked to visit the branch. The Branch manger has visited to Karnal also on 26.03.2025 to verify Mrs. Rainu Kaushal. Since on 20.03.2025 he has transferred the funds of Mr. Shalesh Kaushal, Mr. Sunjay Kaushal and Mrs. Kamla Kaushal only and also of Rainu Kaushal. He has not transferred the balance funds of Mrs. Rainu Kaushal as she was not able to visit the branch on 20.03.2025. Mr. Sanjeev has come to meet Mrs. Rainu Kaushal on 26.03.2025 on half way to Karnal and he has also taken a photo with Mrs. Rainu Kaushal. The funds of Mrs. Rainu kaushal has been transferred after 31.03.2025 as we have been informed to show the balance on PNB Books on 31.03.2025. Mrs. Rainu Kaushal can herself prove this, if required. This kind of harassments the Bank Manager did with us. The Complainant has also filed compliant against the Bank Manager and Bank before the ombudsman; however, the ombudsman was of the opinion that deficiency in service is not the ground of compliant.

In light of the above, this Hon'ble Court is requested to take the strict action against the Punjab National Bank and the Bank Manager who have harassed us two years. The FD’s holder has doubted on the capabilities of the professional and abuses the POA holder just because of PNB malafide and wrong working. Using the funds unauthorized way. Additional expenses incurred by us and spoiled our reputation before the international personalities. This is the pure case of unauthorized use of funds by following the tactics of delaying the transactions in order to avoid the reputation of Indian Bank in International level.

We will be pleased to provide further documents/clarification/statements from NRI as and when required. We rely on the wisdom and judgement of this Hon'ble Court.
