1. Ashwina Kumar D/O Amaresh Kumar Ram was having a function at her college on 15-10-2024. I was looking for a western dress as per the function theme.

2. I came across the brand i.e. Diamond Lady "Diamondlady- Your Dream Wardrobe – diamondlady" while searching online and liked "Rufina dress XXX/RED with price of Rs 1650.00", however she was unsure whether DiamondLady would be able to deliver the order by 14-10-2024. On the in-portal chatroom, on 11-10-2023 at 15:09 PM, she posted the query enquiring about the delivery timeline for Sector 121, Noida if she placed the order now . In chatroom at 3:11PM, she got a response that "if you place an order today, you can opt for same-day or next-day delivery in Noida, Delhi NCR, with extra charges".

3. Based on the above confirmation, she placed the order # 49046 on 12-10-2024 at 9:39 AM with COD option & with a shipping charge of Rs. 379 for express delivery. As per Diamond Lady I also made the partial payment of Rs. 498.00. Invoice of this order is sent on email.

Since I opted for the same day/next day delivery, on 13-10-2024 entire day, I waited for the delivery however the delivery didn't arrive which is a deficiency of the service and breach of the commitment made to the customer before the order is placed. Around 12:07 PM, on an in-portal chatroom, I even enquired about the delivery status of her order but there was no response.

4. On 14-10-2024 at 1:43 PM, I received an email communication from Diamond Lady confirming that the order# 49046 will be delivered on 14-10-2024 which is again a delay of 1-day against the commitment of same day/next day delivery. However, the order was not delivered on 14-10-2024 too.

5. On 15-10-2024, I loaned a dress from her classmate to participate in her college function. The delivery was not made on 14-10-2024, hence with frustration, on 15-10-2024 around 8:55 AM - 8:57AM, on an in-portal chatroom she posted message to cancel the order #49046 and refund the entire advance payment of Rs 498 but there was neither an acknowledgement nor any response.

6. On 16-10-2024, my father, called the contact number# 8800225892 as given on the Diamond Lady portal and discussed the entire context and requested to either deliver the order with refunding the shipping charge for express delivery or cancel the order with the entire amount being refunded. As requested on call, entire details regarding order, confirmation for same day/next day delivery and other are shared. The representative on call threatened that if the customer declined to accept the order then she would lose Rs. 200 as per diamond Lady policy. I objected to this since Diamond Lady has failed to deliver the order within promised time so why does the customer have to lose the money. I also declined to accept the offer of a coupon against refund of shipping charge as customers may not place any order to Diamond Lady in future. On this, the representative on call said that she has forwarded the communication to her senior who will call to discuss the resolution. However till now i.e. 9:30PM no one from Diamond Lady has contacted me with the resolution.

7. I have downloaded the tracking of the order# 49046 from BlueDart AWB# 80622529595. Copy of the same can be seen in attachment #4. As per this tracking the Bluedart has picked up the order from Rohini where Diamond Lady store is located on 14-10-2024 at 11:54AM. That means the order pick up is already delayed so how come the order will be delivered on 13-10-2024 or even 14-10-2024.

8. On 17.20.2024, I served representation on email to Diamond Lady against the order# 49046 to cancel the order on the ground that Diamond Lady has failed to deliver the order on time i.e. same day or next day from the date of order i.e. 12.10.2014 and refund the entire amount of Rs. 498.00 paid in advance against this order. Refund the amount in the same instrument through which the advance payment was made by 18.10.2024. Failing to refund the advance against the order by 18.10.2024 will leave me with no other option than file a petition in the appropriate court where all expenses against the petition including fee of advocate & penalty against the harassment meted out to the young customer will have to be borne by the Diamond Lady.

9. Meanwhile the parcel has been returned to their warehouse on 24.10.2024.

10. Since then, Multiple email reminder has been sent to Diamond Lady but there is no acknowledgement or any response.

10. Till today i.e. 15.11.2024 that is almost a month has elapsed; but the refund has not been issued. Their representative on call and WhatsApp saying that you will receive the refund soon but it's a lie.
