COMPLAINT UNDER SECTION 12 OF THE CONSUMER PROTECTION ACT, 2019

Respectfully submitted:

1. That the complainant purchased a Thomson washing machine on 10th August 2025, which carries a warranty of 2 years on the product and 5 years on the motor.

2. That on 14th January 2026, the complainant raised Service Request No. WB2601140070 regarding malfunctioning of the said washing machine. The product is still under warranty.

3. That the technician deputed by the opposite party visited the complainant’s premises and confirmed that the spin motor was faulty. He assured that a replacement motor would be provided and the repair completed within the following week. However, despite repeated assurances, no action has been taken for over two months, and the washing machine remains unusable.

4. That the complainant has made repeated attempts to contact the opposite party through Mobile/WhatsApp number 9355188885. The line is consistently unreachable, calls are diverted to automated responses, and disconnected without connecting to an agent or providing follow-up. This lack of accessibility and poor communication has caused immense frustration.

5. That the delay in repair and deficiency in service is unacceptable, especially for a product under warranty. The complainant has suffered significant inconvenience, mental agony, and financial loss due to the opposite party’s negligence.

PRAYER:
The complainant respectfully prays that this Hon’ble Forum may kindly direct the opposite party to:

a) Replace the defective spin motor and repair the washing machine immediately.
b) Provide compensation of Rs. 50000 for mental agony, inconvenience, and litigation costs.
c) Pass any other order deemed fit in the interest of justice.
