I am writing to formally lodge a complaint against M/S Ashirwad Engicon Pvt Ltd (referred to as "the Builder") for their failure to deliver the flat as per the terms of the contract and their refusal to refund the amount paid by me.
- Details of the Property and Agreement:
- Builder Name: M/S Ashirwad Engicon Pvt Ltd
- Project Name: Ashirwad PNB Diamond City
- Booking Date: 24th November 2015
- Total Amount Paid: 8 lakh 51 thousand
- Nature of the Complaint:
- The flat, which was promised to be delivered by May 2020, this builder even didn't start the project and giving false promises to give the flat in his another society but has not been allotted despite repeated follow-ups.
- The Builder has failed to fulfill the contractual obligations to refund the amount with 12.5% per annum if possession is not given on situlated time.
- I have filled the cancellation form in November 2023, at that time he was not agreed to pay as per the agreement. He has just been forced to take 17th lakhs only. I agreed to it and my husband (Rajnish Kumar Raj) filled the cancellation form and it was told to us he will return the money with in 6 months. o Despite multiple requests, the Builder has just returned 10 lakhs and stop picking up the phone and not responding.
- This builder mentally harassed me.
- I am not the only one, he looted many customers in Bihar. There are multiple complaints filed against this builder and evidence available on the internet.

Upon further inquiry, I discovered that several other consumers have been similarly cheated by the Builder. Many have paid substantial amounts, and the flats remain undelivered, leaving numerous families in distress.
- Direct the Builder to refund the amount paid with interest for the delay.
- Impose penalties on the Builder for breach of contract and unethical practices.
- Initiate appropriate legal action to safeguard the rights of affected consumers and prevent further exploitation.
