COMPLAINT UNDER SECTIONS 2(11), 2(47), AND 35 OF THE CONSUMER PROTECTION ACT, 2019
Facts of the Case:1) On the month of January 2025, the Complainant purchased a Full Stack Development Course from Opposite Party No. 1, via Opposite Party No. 2 with Loan Reference Number [PRP/572480] Sanctioned Loan amount Rs. 1,19,000/- (One lakhs nineteen thousand only) on dated [05-02-2025] with fixed Interest rate 19.56 % , for a consideration of INR Rs. 1,19,000/- [One lakhs nineteen thousand only], which was paid in full by Opposite Party No. 2 to Opposite Party No. 1, Consequently, a loan with EMIs to be debited monthly from Complainant's account. The Honourable disputes redressal commissioner is hereby respectfully requested to accept it as part of this petition.
2) Due to unforeseen and grave financial hardship and family crisis, the complainant was forced to go to work for daily living and stabilize the family problems, so the complainant no longer wishes to continue with the course and has formally approached your customer care requesting cancellation of enrolment and closure of the loan account. Because no classes have been attended, no course content has been accessed, and no services whatsoever have been availed till the suit will be filed. As per Terms and Conditions of Opposite Party 1. The Honourable disputes redressal commissioner is hereby respectfully requested to accept it as part of this petition.
3) The service refund will be 7 (Seven Days) from the batch start day as per Terms and Conditions by Opposite Party No. 1 and the true fact is Complainant does not start the course until the suit will be filed, it came with a refund policy of Opposite Party 1 from the date of batch starting day. Video Proof for not attending class from M/s. Sunrise Mentors Private Limited Trading as Code Ninja. The Honourable disputes redressal commissioner is hereby respectfully requested to accept it as part of this petition.
4) Complainant approached Opposite Party No. 1 on 13-05-2025 and request the cancellation of his enrolment in Full Stack Developer course due to an unexpected medical emergency in his family that requires, his immediate and on-going attention, The Complainant request the Opposite Party 1 for Cancellation of Loan and Refund the course fee on basis of humanity.
5) Opposite Party 1 citing outside refund period via mail on 14-05-2025 & 16-05-2025, which amounts to a deficiency in service as defined under Section 2(11) of the Consumer Protection Act, 2019. The Honourable disputes redressal commissioner is hereby respectfully requested to accept it as part of this petition.
6) The Complainant approached Opposite Party’s via legal Notice on [21-05-2025] for Cancellation of Loan, Refund & cancel the auto debt policy. Opposite Party 1 failed to provide adequate service or reply for the legal notice by Complainant on [21-05-2025].
7) Further, the Opposite Parties engaged in misleading advertisements, claiming the service to be high quality, which constitutes an unfair trade practice under Section 2(47) of the Consumer Protection Act, 2019, as the product failed to meet the promised standards.
Cause of Action:
The cause of action arose on [21-05-2025] when the Opposite Parties refused to address the Complainant’s grievance, resulting in financial loss, mental agony, and inconvenience.
