I, Lingala Bhagya, resident of Bhagat Nagar, Karimnagar, Telangana (Address: 8-3-245/B/1), am filing this complaint against One MobiKwik Systems Private Limited ("MobiKwik") for its gross negligence and repeated harassment, which has caused me significant emotional distress.
This harassment comes at a time when my family is already under tremendous emotional and financial strain as my husband has been battling cancer since May 2024. Despite our relentless fight against his disease and the devastating recurrence in September, MobiKwik and its agents have chosen to repeatedly target and harass me with calls, vulgar messages, and defamatory threats.
### Background of the Issue:
On 02-Aug-2024, I was the victim of a fraudulent transaction involving my MobiKwik account.
- I received a call from someone claiming to be from MobiKwik Customer Support.
- I was asked to enter an OTP to cancel an unauthorized transaction.
- Immediately after entering the OTP, money was fraudulently debited from my account.
I raised a complaint with MobiKwik’s customer support team on the same day (Complaint Reference No.: 20083864) and provided all details to help their investigation. Since then, I have not received any response or resolution from MobiKwik regarding the fraud.
### Unethical and Harassing Behavior:
Instead of resolving my legitimate complaint, MobiKwik has subjected me to relentless harassment through its loan recovery agents, including:
1. Frequent Calls and Vulgar Messages: I have been bombarded with daily calls and abusive messages since September 2024.
2. Threats of Public Humiliation: Recovery agents have threatened to come to my house, involve my neighbors, and label me a fraudster. These threats have caused me immense fear and humiliation.
3. Warnings of Legal Action: Despite being the victim of fraud, I have been served legal notices, further escalating my mental and emotional stress.
### Impact on My Life:
1. Mental and Emotional Distress:
My husband is battling cancer, and our family is struggling to meet his medical and emotional needs. The recurrence of his illness in September has left me barely able to eat or function normally. Instead of supporting me, MobiKwik has added to my suffering by harassing me with abusive calls and threats.
2. Fear for Safety:
The threats of agents visiting my home and defaming me in my neighborhood have left me feeling unsafe in my own home. I live in constant fear of public humiliation, even though I am not at fault.
3. Financial Strain:
My husband’s cancer treatment has drained our resources, and I am not in a position to bear additional costs or fight unjustified legal battles caused by MobiKwik’s negligence.
### Relief Sought:
I humbly request the Honorable Consumer Court to:
1. Order MobiKwik to Investigate and Resolve the Issue: Direct MobiKwik to address the fraudulent transaction on my account, take responsibility for their lack of security measures, and close all claims related to this matter.
2. Stop Harassment: Immediately stop all recovery-related calls, messages, and threats against me.
3. Compensation: Grant compensation for the mental stress, harassment, and emotional trauma caused by MobiKwik and its agents.
4. Take Strict Action Against Abusive Practices: Penalize MobiKwik for enabling unethical recovery practices, including vulgar messages, public threats, and defamation.
5. Issue a Formal Apology: Seek a written apology from MobiKwik for the undue harassment caused to me during a time of personal crisis.
