Respected Sir/Madam,


I am filing a formal consumer complaint against Wakefit Innovations Pvt. Ltd. for severe deficiency in service, delivery of defective goods, non-delivery of paid items, and refusal to provide refund, causing me financial loss and mental harassment.



1. Summary of Events​


  1. I purchased a 7-seater sofa set from Wakefit on 12th October 2025, with the company promising complete delivery within 10 days.
  2. However, they failed to honour their commitment and delivered the items in an unprofessional and delayed manner:
    • First part delivered on 17th October (5 days late)
    • Second part delivered on 1st November (20 days late)
    • Third part still not delivered till today
  3. The parts delivered are defective and appear to be used, including:
    • Visible wrinkles on the stitching,
    • Clear scratches on the sofa legs,
    • Poor finishing and signs of prior usage.
  4. I immediately raised complaints regarding the defects and the abnormal delays.
  5. Instead of providing timely support or refund, Wakefit has been unresponsive, and their team has only offered replacement, which I do not accept, because:
    • The product is defective,
    • Delivery was delayed by more than one month,
    • Trust is lost in the company,
    • I no longer want any item from Wakefit.
  6. Wakefit has refused to refund the amount, despite their failure to deliver the product on time and the defective condition of the items delivered.


2. Legal Violations​


Wakefit’s actions violate multiple provisions of the Consumer Protection Act, 2019, including:


  • Deficiency in Service (Section 2(11))
  • Defective Goods (Section 2(10))
  • Unfair Trade Practice (Section 2(47))
  • Failure to Deliver Goods Within Committed Time (Sections 73 & 74)
  • Breach of Contract (Indian Contract Act, 1872)

Delivering used/defective items and refusing a refund constitutes clear misconduct and malpractice.



3. Relief & Compensation Requested​


I request the Hon’ble Commission to direct Wakefit to:


  1. Issue a full refund of the entire purchase amount, and
  2. Pay ₹1,00,000 (One Lakhs) as compensation for:
    • Mental harassment,
    • Defective goods,
    • Excessive delivery delay,
    • Time wasted and inconvenience,
    • Legal and incidental expenses.

Since I no longer have any trust in the company, I do not want any replacement product from Wakefit.

I declare that the facts stated above are true and correct to the best of my knowledge. I request the Hon’ble Commission to kindly take action against Wakefit Innovations Pvt. Ltd. and help me obtain justice.
