I, Jismi, the complainant herein, respectfully submit this complaint against the above-mentioned opposite party for deficiency in service and unfair trade practice. On 28 September, I placed an online order for four (4) dress items from Fathis Designs and paid the full
amount of Rs. 10,306.45.

The payment was successfully completed, and I possess valid payment confirmation as proof.
As per the delivery policy published on the opposite party’s official website, the products are to be delivered within 25–30 working days, and in case of any delay, the customer will be informed in advance via email. The policy also states that tracking details will be shared once the order is shipped.
However, despite the lapse of the promised delivery period:The ordered items have not been delivered .No shipment tracking details have been provided, and No prior intimation or satisfactory response has been given, even after repeated follow-ups and warning messages.
The failure to deliver the goods within the promised time frame, coupled with non-communication and non-refund after receiving full payment, constitutes a clear case of deficiency in service and unfair trade practice
under the Consumer Protection Act.
I made sincere attempts to resolve the issue directly with the opposite party, but no corrective action was taken.
I therefore humbly request this Hon’ble Commission to kindly:
Direct the opposite party to refund the full amount of Rs. 10,306.45,
Award reasonable compensation for mental agony, inconvenience, and financial loss suffered due to the prolonged delay and non-response, and Grant any other relief deemed fit and proper in the interest of justice.
I am enclosing copies of the payment receipt, order confirmation, screenshots of communication, and a copy of the delivery policy as displayed on the opposite party’s website for kind consideration.
I shall be grateful for the timely intervention of this Hon’ble Commission.
