Complainant: Arun Rathaur, a student, contact: 7983093312, email: arunrathour4456@gmail.com.Opposite Parties: FatakPay Digital Pvt Ltd, Ground Floor, Office No. 1, Technopolis Knowledge Park, Mahakali Caves Road, Nelco Complex, Andheri East, Mumbai - 400093, email: help@fatakpay.com.FDPL Finance Pvt Ltd, same address, email: grievance@fdplfinance.com.Complaint Details:
I, Arun Rathaur, a student with no income was granted a ₹7500 loan at 173.42% APR by FDPL Finance Pvt Ltd via FatakPay on April 12, 2025, due May 30, 2025. The loan was issued without verifying my income or acknowledging my student status, reflecting predatory lending practices. FDPL is not on the RBI CMS portal, suggesting illegal lending. Since May 2025, I’ve faced daily SMS and threats from recovery agents to visit my home, impacting my studies and mental health, possibly violating Section 503 of the Indian Penal Code (criminal intimidation). I emailed grievances to grievance@fdplfinance.com (May 21, 07:31 PM IST; May 22, 01:53 PM IST) and help@fatakpay.com, but received no reply. On May 23, 2025, at 04:52 PM IST, I sent a DM to @FatakPay on X, demanding: 1) stop harassment immediately, and 2) extend repayment to 3 July 2025, with a response deadline of May 24, 2025. FatakPay replied on May 24, promising their team would contact me by 5:30 PM IST, but as of 09:37 PM IST, no one has, and they’re not replying to further messages. The harassment continues, exacerbating my distress. I’ve filed complaints with RBI SACHET, the cyber cell, and an earlier consumer court case (May 21, 2025, via e-Daakhil).Relief Sought:Immediate cessation of harassment (SMS, threats, recovery actions).Extension of loan repayment to 3 July 2025.Compensation of ₹50,000 for mental distress and academic disruption.Investigation into FDPL’s unregistered status and FatakPay’s practices.Legal action against the opposite parties for predatory lending and harassment.Evidence: Loan agreement, SMS screenshots, call logs, X DMs (including FatakPay’s reply and non-responsiveness), prior complaint records.
