Respected Sir/Madam,
With due respect, I want to draw your kind attention that I, Mrs. Suparna Mukherjee and my husband Mr. Rohit Lahiri had invested a total amount of One Lakh Forty Four Thousand Seven Hundred Rupees (Rs. 144700) plus Seven Thousand Five Hundred (Rs. 7500), to the proprietor of Aqua Fish Farming, Anirban Dutta, to prepare a tank culture of fish farming at our rented house in 427 Q, Talpukur Road, Behala, Kolkata – 700061 which has been started on 20th February, 2024. The person, Anirban Dutta, made an agreement with us that he and his firm would prepare a tank culture in our rented place providing the tank set up, fish sidling, fish food and medicines and when the fishes grow he would buy the grown up fishes in proper prices from us. The fish seedlings were of Climbing Perch Fish/Walking Cat Fish (Koi Fish). The agreement was for six months and within that period 2 fish farming ought to have been completed. As soon as the tank preparation and water preparation was completed by Anirban Dutta and the seedlings were dropped into our tank full of water, they used to die one by one. Anirban Dutta did not do channel in our tank to pass out dirty water and to enter the cleaned water through that channel during farming and advised us to buy some buckets to place in the tank to clear out the dirty water. We bought the same according to his advice and he placed the same in our tank. But this did not work and all fishes died. Then he told us to do extra construction under the tank to create the channels in the tank and this took another Thirty Thousand Rupees of us to do extra constructions by masons. Then he promised to give seedling again for farming, but he failed to give so. He only wasted our time and harrassed us by telling lies that he would give seedlings and he was on the way to our house. We had waited and waited but he did not give any further seedlings. Even he told a story naming Kalam, a fish farmer at Kalna who would give somewhat grown up fishes to Anirban Dutta to fill up our tank and for giving food to them he took another Rs. 1000 from us for the purpose. Then he took lame excuses of floods and snakes and did not provide the fishes. Then he gave some dates and told that the fishes are fully grown up and he would sell the same in Durgapur Benacity market and Asansol market and pay back the profit amount to us, but failed to do so. All these story of him had no proof as he did not show anything. During extra construction of tank after the loss that Anirban Dutta took from us another Rs. 6500 online for buying filter for fish farming but he never bought the same and never refunded the money after our seeking the money repeatedly from him to refund. So, our another Rs. 7500 (For filter but not bought and for fish food in Kalam’s house to feed, the fishes are not given and never shown to us) were gone. So, after paying One Lakh Forty Four Thousand and Seven Hundred Rupees (Rs. 1,44,700), we had to pay another Seven Thousand Five Hundred Rupees (Rs. 7500), total of being One Lakh Fifty Two Thousand and Two Hundred Rupees (Rs. 1,52,200) but all our money and effort were in vain in the hand of the cheater Anirban Dutta. Evidence of our payment to him are there with us. Anirban Dutta failed his agreement with us and took money from us only and did not give us any return. After his failure, when we corresponded with him to do mutual settlement to at least sell out tanks and oxygen machines to give us the return, then also he gave false promise and did not help us at all. We could not find his address of his farming station as given in his bills as “Aqua Fish Farming, Diyara Station Road, Diyara, Hooghly, West Bengal” and when we told him that thing he told that his address of farming is there only and we could not be able to find it out. Fortunately, we know his residential address which is 36/H, Ram Mohan Sarani, Champdani, Baidyabati, Hooghly 712222, West Bengal and his landmark is Sadhukhan Khamardanga or Sadhukhan Gola from 1 no. platform of Baidyabati Station, where we repeatedly went for solution but everytime he was not in his house and his wife faced us and they could not help us to revive our losses where that Anirban Dutta is held responsible for our losses. One day he met with us in Bongaon Station to do fish trade with someone and give us the return. The whole day he roamed with us giving false phone numbers and all for the purpose of fish trading which were remained switched off and dramatically that Anirban Dutta told that the trader is not contactable but when he pre-negotiated with him he was contactable. In this way, we were harassed and good money of us is wasted for the purpose of conveyance and tiffin for going there and returning. Further, our time and effort are also wasted. In this way, this cheater Anirban Dutta only harassed us with his newly invented stories and all and took our money only falling us with huge losses. We are in financial crisis for him.
Further, we prepared the firm in a rented house and we had to pay the monthly rent of Eight Thousand Rupees (Rs. 8000) and electric and pump bill with a huge loss. We have to do extra construction also for Anirban Dutta's fault which is another Thirty Thousand Rupees (Rs. 30000). This was also extra amount expended for the loss project.
So, looking above, please help us to file a consumer court case against Anirban Dutta.
