Complainant purchased an ELICA Pro FB MFC 3B 75 DX FFD Hob from Respondent No. 2 (Dealer – DECURE, Mumbai) vide Invoice No. 252601935 dated 23/12/2025 for Rs 48,000/-. The product was marketed and described in the brochure as “Built In Stainless Steel Hob” The model name also contains the expression “INOX” which in common trade parlance denotes stainless steel construction. Relying on this representation, the Complainant purchased the product.

The hob was installed on 05/01/2026 at the Complainant’s residence in Indore by Respondent No. 1’s authorised technician. Upon installation, it was discovered that the body of the hob is not stainless steel but is constructed of 6 mm toughened glass, merely covered/wrapped with a thin stainless steel sheet for cosmetic appearance. The instruction manual, supplied only after opening the sealed package, refers to toughened glass as the base material.

Thus, there is a material contradiction between the advertisement representation (Stainless Steel Hob) and the actual construction of the product. The Complainant’s purchase decision was induced by the representation that the hob was stainless steel. Post-sale disclosure in the instruction manual cannot cure pre-sale misrepresentation.

Despite written complaints and reminders to both Respondents, no satisfactory response or resolution has been provided. The acts of the Respondents amount to misleading advertisement, unfair trade practice, defect in goods, and deficiency in service.

The Complainant therefore seeks replacement with a genuine stainless steel body hob of identical specifications or refund of Rs 48,000/- with interest, along with compensation for mental agony and litigation costs.
