1. FACTS OF THE CASE
a. The Complainant is a 'Consumer' as defined under the Consumer Protection Act, 2019, having purchased the goods for personal use.
b. On 27 Dec 2020 the Complainant purchased a 3L capacity Electric Water Geyser of the model Orient Company manufactured by Orient Electric and sold by Consulting Rooms Private Limited ,, for a consideration of Rs. 2199. A copy of the Invoice/Bill No. # FAC9872100387438 dated 27 Dec 2020 is annexed herewith.
c. The warranty period for the said product expired on or about 27 Dec 2022 . However, the defect concerning the leakage of electrical current, which is a latent manufacturing flaw, has resulted in a life-hazardous situation. My family turned off the main power to protect my life. Geyser was emitting high Voltage current.
d. The defect in the Geyser is an absolute failure of the product's safety mechanism, making it inherently hazardous to life and property. This is a direct violation of the fundamental consumer right to safety.
e. The Complainant immediately contacted Opposite Party No. 1/2 on 25 Nov 2025 via Service call but the defect was not rectified/resolved to satisfaction, despite the serious and life-threatening nature of the failure
2. GROUNDS OF COMPLAINT
a. Defective Goods and Product Liability: The Geyser is defective as defined under the Act, as it suffers from a fault/imperfection in quality, posing a severe risk. The Opposite Parties are liable under a Product Liability Action for the harm and imminent danger caused by this defective product.
b. Violation of Right to Safety: The Opposite Parties have failed to protect the consumer from a product that is hazardous to life and health, violating the Complainant's Right to Safety as enshrined in the Consumer Protection Act.
c. Negligence: The manufacturing and sale of a life-threatening electrical appliance demonstrates gross negligence and an unfair trade practice on the part of the Opposite Parties.
d. Non-Applicability of Warranty Period to Life-Hazardous Defects: The defense of an expired warranty is irrelevant in this case, as the defect is one of fundamental and latent manufacturing failure that directly compromises the physical safety and life of the consumer.
This complaint is primarily based on the Product Liability Action and the Right to Safety, which are not strictly bounded by the conventional warranty period when the defect is inherently dangerous and violates mandatory safety standards.
