Respected Sir/Madam,

Request your help here to take strict penalty action against flip kart and help me compensate for continuous cancellation of 595 Litre LG side by side Refrigerator costing INR 1,19,789/- where the seller has been repeatedly sending the same damaged product on every time re-order of same model product. I have done countless call to customer care explaining the situation and requesting to address the issue which was promised to me to provide good quality product. However, every time it ended up in same situation of cancellation of order due to damaged product being delivered. This has resulted in blocking my amount for last seven months approx. and caused me mental tension and frustration. On each and every order raised I have to follow-up with Flipkart customer care and explain them the situation resulting in no solution and only frustration and anger. Also considering this amount was invested in Fixed Deposit could have generated interest of INR 5000 to INR 6000.

The Brief Facts of the complaint are: that the complainant has placed an order Realme 108 cm Smart Android TV with Android 11-2022 Model IMEI No. 01CFTV438220500885, on 4" June,2023, order ID: OD328270283649617100, invoice No. FAMT052400203630 and paid Rs.21,499/- (Rupees Twenty-One Thousand Four Hundred and Ninety-Nine only) to the opposite party. The complainant has stated that he received the product on 5" June 2023 and the installation was done on 8" June, 2023 by Realme service personnel, during installation, the Realme service team identified a defect in the TV display and they documented the defect through videos and photographs and advised the complainant to initiate an exchange, the complainant contacted the opposite party's concern for return refund request and Realme customer service informed the complainant that the invoice IMEI number and TV IMEI number did not match, the opposite party representatives failed to provide a resolution and closed the complaint unilaterally without informing the complainant. Despite repeated efforts to resolve the issue through multiple telephonic and email communications but the opposite party has not provided a replacement or refund, for that the complainant issued a legal notice through “Online Legal India” on 12" June,2023, the opposite party received the notice on 17" June,2023 but did not respond or not taken any action to resolve the said issue, the complainant alleged negligence and accuses the opposite party of engaging in unfair trade practices and providing poor service, causing unnecessary mental stress and financial loss to the complainant , further claims that the opposite party failed to provide proper service despite receiving full payment for the product amounting to deficiency in service under the Consumer Protection Act,2019, hence the complainant has been constrained to file the present complaint against the opposite parties in order to refund an amount of Rs. 21,499/- (Rupees Twenty-One Thousand Four Hundred and Ninety-Nine only), Rs.40,000/- (Rupees Forty Thousand only) towards compensation as well as Rs.10,000/- (Rupees Ten Thousand only) towards litigation expenses.
