Facts of the Case:
That the complainant purchased a Nirlon Hand Blender from 5245-ESM Canteen, Barara, Haryana on 9 January 2025, for personal domestic use.
That the product was sold with a 12-month manufacturer warranty, valid till 8 January 2026, as mentioned on the warranty card.
That within the warranty period, the said hand blender stopped functioning properly and developed a technical defect, making it unfit for use.
That the complainant contacted Nirlon Customer Care multiple times through email and phone calls, requesting repair or replacement of the defective product.
That despite repeated follow-ups, no response, resolution, or service support was provided by the opposite party.
That the complainant also submitted a written warranty claim email along with copies of the invoice, warranty card, and product photographs, but no action was taken.
That the inaction and negligence of the opposite party amounts to deficiency in service and unfair trade practice under the Consumer Protection Act, 2019.
Cause of Action:
The cause of action arose on the date when the product became defective and continues till date due to the failure of the opposite party to honor the warranty obligations.
